This book applies the broader debate in the field of political science over the advantages of a parliamentary system to the case of the United States. It asks whether it is better for a democracy to function under a parliamentary or presidential system. Using the example of a parliamentary alternative to the American presidential system, Checks and Balances? How a Parliamentary System Could Change American Politics illustrates how the Constitutional system of checks and balances functions, including the separation of powers and the legislative process. This book is designed to help American readers better understand their own form of government, while expanding their knowledge of other governments.

When the first two volumes of William Crosskey's monumental study of the Constitution appeared in 1953, Arthur M. Schlesinger called it "perhaps the most fertile commentary on that document since The Federalist papers." It was highly controversial as well. The work was a comprehensive reassessment of the meaning of the Constitution, based on examination of eighteenth-century usages of key political and legal concepts and terms. Crosskey's basic thesis was that the Founding Fathers truly intended a government with plenary, nationwide powers, and not, as in the received views, a limited federalism. This third volume of Politics and the Constitution, which Crosskey began and William Jeffrey has finished, treats political activity in the period 1776-87, and is in many ways the heart of the work as Crosskey conceived it. In support of the lexicographic analysis of volumes 1 and 2, volume 3 shows that nationalist ideas and sentiments were a powerful force in American public opinion from the Revolution to the eve of the Constitutional Convention. The creation of a generally empowered national government in Philadelphia, it is argued, was the fruition of a long-active political movement, not the unintended or accidental result of a temporary conservative coalition. This view of the political background of the Constitutional Convention directly challenges the Madisonian-Jeffersonian orthodoxy on the subject. In support of his interpretation, Crosskey amassed a wealth of primary source materials, including heretofore unexplored pamphlets and newspapers. This exhaustive research makes this unique work invaluable for scholars of the period, both for the primary sources collected as well as for the provocative interpretation offered.

The Oxford Handbook Of Comparative Political Theory written by Leigh K. Jenco and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2019-12-01 with Political Science categories.

Increased flows of people, capital, and ideas across geographic borders raise urgent challenges to the existing terms and practices of politics. Comparative political theory seeks to devise new intellectual frames for addressing these challenges by questioning the canonical (that is, Euro-American) categories that have historically shaped inquiry in political theory and other disciplines. It does this byanalyzing normative claims, discursive structures, and formations of power in and from all parts of the world. By looking to alternative bodies of thought and experience, as well as the terms we might use to critically examine them, comparative political theory encourages self-reflexivity about the premises of normative ideas and articulates new possibilities for political theory and practice. The Oxford Handbook of Comparative Political Theory provides an entry point into this burgeoning field by both synthesizing and challenging the terms which motivate it. Over the course of five thematic sections and thirty-three chapters, this volume surveys the field and archives of comparative political theory, bringing the many approaches to the field into conversation for the first time. Sections address geographic location as a subject of political theorizing; how the past becomes a key site for staking political claims; the politics of translation and appropriation; the justification of political authority; and questions of disciplinary commitment and rules of knowledge. Ultimately, the handbook demonstrates how mainstream political theory can and must be enriched through attention to genuinely global, rather than parochially Euro-American, contributions to political thinking.

Religion Law And The Constitution written by Javier García Oliva and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-08-10 with Law categories.

This book examines the existing constitutional and legal system in England, Wales and Scotland, through the prism of its treatment of religion and belief. The study encompasses questions of Church/state relations, but pushes far beyond these. It asks whether the approach to religion which has spread out from establishment to permeate the whole legal framework is a cause of concern or celebration in relation to individual and collective freedoms. The primary focus of the work is the synergy between the religious dimension of the juridical system and the fundamental pillars of the Constitution (parliamentary sovereignty, the rule of law, separation of powers and human rights). Javier García Oliva and Helen Hall challenge the view that separation between public and religious authorities is the most conducive means of nurturing a free and democratic society in modern Britain. The authors explore whether, counter-intuitively for some, the religious dynamic to the legal system actually operates to safeguard liberties, and has a role in generating an inclusive and adaptable backdrop for our collective life. They suggest that the present paradigm brings benefits for citizens of all shades of religious belief and opinion (including Atheist and Humanist perspectives), as well as secondary advantages for those with profound beliefs on non-religious matters, such as pacifism and veganism. In support of their contentions, García Oliva and Hall examine how the religious dimension of the legal framework operates to further essential constitutional principles in diverse settings, ranging from criminal to family law. In a groundbreaking move, the authors also set the legal discussion alongside its social and cultural context. They consider how the theological perspectives of the larger faith traditions might influence members’ ideas around the key constitutional precepts, and they include extracts from interviews which give the personal perspective of more than 100 individuals on contemporary issues of law and religious freedom. These voices are drawn from a range of fields and positions on faith. While the authors are at pains to stress that these sections do not support or advance their legal or theological conclusions, they do provide readers with a human backdrop to the discussion, and demonstrate its crucial importance in twenty-first century Britain.
