In 2014 the world’s most widely ratified human rights treaty, one specifically for children, reached the milestone of its twenty-fifth anniversary. The UN Convention on the Rights of the Child was adopted after the fall of the Berlin Wall, and in the time since then it has entered a new century, reshaping laws, policies, institutions and practices across the globe, along with fundamental conceptions of who children are, their rights and entitlements, and society’s duties and obligations to them. Yet despite its rapid entry into force worldwide, there are concerns that the Convention remains a high-level paper treaty without the traction on the ground needed to address ever-continuing violations of children’s rights. This book, based on papers from the conference ‘25 Years CRC’ held by the Department of Child Law at Leiden University, draws together a rich collection of research and insight by academics, practitioners, NGOs and other specialists to reflect on the lessons of the past 25 years, take stock of how international rights find their way into children’s lives at the local level, and explore the frontiers of children’s rights for the 25 years ahead.

This book provides a vital and original investigation into, and critique of, the situation facing the realisation of the child’s right to play. The right to play has been referred to as a forgotten right – forgotten by States implementing the Convention on the Rights of the Child, by the Committee on the Rights of the Child in monitoring and providing guidance on the Convention, and by human rights academics. Through multidisciplinary, original archival, novel doctrinal and primary empirical research, the work provides a thorough investigation of the right to play. It offers an innovative insight into its value, the challenges facing the realisation of the right, its raison d’être and its scope, content and obligations. It also critiques the Committee’s engagement with the right to play and shares lived experiences of efforts to support its implementation in the United Kingdom and Tanzania. The book highlights elements of best practice, challenges, and weaknesses, and makes recommendations for the continued and improved realisation of the right to play. The book will be a valuable resource for researchers, academics, advocates and policy-makers working in the areas of Children’s Rights, International Human Rights Law, Public International Law, Child Welfare, and Education.

This book provides different perspectives on the concept of children’s rights, including policy, educational, and children’s perspectives. It examines how the crucial ideas of the Convention on the Rights of the Child are respected and implemented in 14 countries in five regions of the world. It looks at early childhood education, children’s participatory rights, and at how these rights are promoted and guaranteed in different countries. It explores the professional practice of education and its complexities, challenges and dilemmas, as well as the role of play, and of listening and participation. The book advocates children’s rights today, arguing for its vital importance, in the best interests of the children. In doing so, it furthers the understanding of children’s rights and spreads knowledge about the Convention, as a means of celebrating its 30th anniversary. The UN Convention on the Rights of the Child (UNCRC) comprises the potential to change the lives of children to the very best. It may exalt children from the position of marginalized citizens to the centre of policies all over the world. Even though the concept of children’s rights is omnipresent, the respect for children’s rights must be discussed. While the Convention brings the new perspective of children as citizens to the world, there are still challenges in its application. The book interrogates challenges in understanding and applying children rights and offers possible answers to these challenges. The ratification process itself, does not guarantee that children’s rights are respected. While all adults should take responsibility for implementing the UNCRC in everyday life, Early Childhood Education should give opportunities for children to learn and live their rights.

When you were born, a song began... So begins this lyrical and unique non-fiction picture book by award-winning children's author Nicola Davies. With tenderness and a good deal of heart, Nicola introduces young readers to the universal rights that every child is entitled to under the United Nations Convention on the Rights of the Child. Using the metaphor of song, the book opens with the arrival of a newborn and its unique 'song', then pans out to explore all the essential things that every song needs to thrive - love, protection, a home, a name, the chance to explore and learn. In the latter half of the book, the issues of child labour, exploitation and war are sensitively introduced to emphasise that we all must play our part in championing children's rights and offering support to those who need it most. With beautiful and deeply moving watercolour illustrations by award-winning artist Marc Martin, this is a book that encourages children, and the adults in their lives, to speak up for young people all around the world, and to treat one another with compassion and kindness.

Play is fundamental to children’s health, wellbeing and development. Yet in the modern world, their space and opportunity to play is under threat. This is the first book to look in detail at children’s play within public policy. Using the UK government’s play strategy for England (2008-10) as a detailed case study, it explores states’ obligations to children under the UN Convention on the Rights of the Child and the General Comment of 2013. It presents evidence that strategies for public health, education and even environmental sustainability would be more effective with a better-informed perspective about the nature of play and the importance of allowing children more time and space for it. The book throws down a challenge to both play advocates and governments, to make effective policy that respects, protects and fulfils children’s right to play as a priority. It is an essential tool for practitioners and campaigners around the world.

It provides a detailed insight into the drafting history of these instruments, the scope and nature of the rights accorded to children, and the obligations imposed on states to secure the implementation of these rights. In doing so, it draws on the work of the Committee on the Rights of the Child, international, regional, and domestic courts, academic and interdisciplinary scholarly analyses. This open access book presents a discussion on human rights-based attributes for each article pertinent to the substantive rights of children, as defined in the United Nations Convention on the Rights of the Child (UNCRC). It provides the reader with a unique and clear overview of the scope and core content of the articles, together with an analysis of the latest jurisprudence of the UN Committee on the Rights of the Child. For each article of the UNCRC, the authors explore the nature and scope of corresponding State obligations, and identify the main features that need to be taken into consideration when assessing a State’s progressive implementation of the UNCRC. This analysis considers which aspects of a given right are most important to track, in order to monitor States' implementation of any given right, and whether there is any resultant change in the lives of children. This approach transforms the narrative of legal international standards concerning a given right into a set of characteristics that ensure no aspect of said right is overlooked. The book develops a clear and comprehensive understanding of the UNCRC that can be used as an introduction to the rights and principles it contains, and to identify directions for future policy and strategy development in compliance with the UNCRC. As such, it offers an invaluable reference guide for researchers and students in the field of childhood and children’s rights studies, as well as a wide range of professionals and organisations concerned with the subject.

This book provides a commentary on the United Nations Convention on the Rights of the Child, which was adopted by the General Assembly of the United Nations on 20 November 1989. Part One contains a general introduction to the Convention on the Rights of the Child, and deals with matters such as the drafting history, the contents, direct application, horizontal effects, limitations, the Committee on the Rights of the Child, and the Convention's final provisions. Part Two contains an article-by-article commentary, the aim of which is not to give an interpretation of the precise nature and scope of States parties' obligations but, rather, to identify the materials, or sources, which provide guidance in that regard. In the identification of such materials, attention has been paid to the general rules of treaty interpretation, as set forth in the Vienna Convention on the Law of Treaties.
