In recent years there has been a substantial debate over the interconnection between labour rights and human rights. Consequently, the jurisprudence of the European Court of Human Rights (ECtHR) concerning substantive individual labour rights, or ‘rights at work’, is coming to greater prominence at the national level throughout the forty-seven Member States of the Council of Europe. This is the first book in English to provide a thorough analysis of the Court’s most recent case law – cases considered in the period from 1963 to 2016 – on fundamental employment rights such as the right to wages, protection from discrimination and unfair dismissal, the right to occupational safety at work, and civil liberties such as the freedom of association, the freedom of religion and expression, and the right to privacy. Drawing on close scrutiny of 347 cases since 1963, the author traces the evolutionary development of the Court’s positions on labour rights as human rights through case analyses, commentary, and general conclusions in each of several categorical groupings. Recent trends are treated in substantial detail. Among the issues and topics raised are the following: – interrelation of ECtHR case law and national labour rights protection; – benefits for employees of reference to ECtHR case law in national proceedings; – role of International Labour Organization conventions and of the European Social Charter in the Court’s reasoning; – application of balancing and proportionality test in relevant to labour law cases; – public criticism of employer, disclosure of information, and standards of whistle-blowers’ protection; and – positive obligations of the State in the ¬field of occupational safety and health. This book offers the most detailed and considered analysis available of how individual labour rights have been referred to in the human rights jurisprudence of the ECtHR. Given that the Court’s positions have already changed certain aspects of some national labour laws, this peerless volume will prove indispensable for practitioners and scholars monitoring the growing applicability of human rights law in matters of labour and employment, especially in the areas of protection of wages, unjust dismissal, and occupational safety.

Theocracy Secularism And Islam In Turkey written by Christopher Houston and has been published by Springer Nature this book supported file pdf, txt, epub, kindle and other format this book has been release on 2021-08-12 with Religion categories.

In this novel and lucid work, Christopher Houston clarifies a particular modern style and practice of politics that he calls anthropocracy. In the name of popular sovereignty, anthropocracies de-legitimize the rule of God(s) even as they re-deploy it to stabilize the rule of the representatives of the people, all the while obfuscating their political conscription of the divine. In distinguishing anthropocracy from varieties of other secular and laicist political arrangements, as well as from theocracy, this book also gives readers a brilliant solution to what it calls the Turkish puzzle, the dilemma over how to best describe and analyze state-religion and state-society relations in the Turkish Republic. This work convincingly undermines two orthodox presumptions about Turkish politics: the claim that Turkish modernity should be considered an example of secularity; and the accusation that the current AKP government should be interpreted as Islamic. On the contrary, it argues that both Kemalism and the AKP continue to institute an anthropocratic Republic.

"The Oxford Handbook of Peace History uniquely explores the distinctive dynamics of peacemaking across time and place, and analyzing how past and present societies have created diverse cultures of peace and applied strategies for peaceful change. The analysis draws upon the expertise of many well-respected and distinguished scholars from disciplines such as anthropology, economics, history, international relations, journalism, peace studies, sociology, and theology. This work is divided into six parts. The first three sections address the chronological sweep of peace history from the Ancient Egyptians to the present while the last three cover biographical profiles of peace advocates, key issues in peace history, and the future of peace history. A central theme throughout is that the quest for peace is far more than the absence of war or the pursuit of social justice ideals. Students and scholars, alike, will appreciate that this work examines the field of peace history from an international perspective and expands analysis beyond traditional Eurocentric frameworks. This volume also goes far beyond previously published handbooks and anthologies in answering what are the strengths and limits of peace history as a discipline, and what can it offer for the future. It also has the unique features of a state-of-the-field introduction with a detailed treatment of peace history historiography and a chapter written by a noted archivist in the field that provides a comprehensive list of peace research resources. It is a work ably suited applicable for classrooms and scholarly bookshelves"--

The status of the refugee in international law, and of everyone entitled to protection, has ever been precarious, not least in times of heightened and heated debate: people have always moved in search of safety, and they always will. In this completely revised and updated edition, the authors cast new light on the refugee definition, the meaning of persecution, including with regard to gender and sexual orientation, and the protection due to refugees and those affected by statelessness or disasters. They review the fundamental principle of non-refoulement as a restraint on the conduct of States, even as States themselves seek new ways to prevent the arrival of those in search of refuge. Related principles of protection—non-discrimination, due process, rescue at sea, and solutions— are analysed in light of the actual practice of States, UNHCR, and treaty-monitoring bodies. The authors closely examine relevant international standards, and the role of UNHCR, States, and civil society, in providing protection, contributing to the development of international refugee law, and promoting solutions. New chapters focus on the evolving rules on nationality, statelessness, and displacement due to disasters and climate change. This expanded edition factors in the challenges posed by the movement of people across land and sea in search of refuge, and their interception, reception, and later treatment. The overall aim remains the same as in previous editions: to provide a sound basis for protection in international law, taking full account of State and community interests and recognizing the need to bridge gaps in the regime which now has 100 years of law and practice behind it.

The right to freedom of religion or belief, as enshrined in international human rights documents, is unique in its formulation in that it provides protection for the enjoyment of the rights "in community with others". This book explores the notion of the collective dimension of freedom of religion or belief with a view to advance the protection of this right. The book considers Turkey which provides a useful test case where both the domestic legislation can be assessed against international standards, while at the same time lessons can be drawn for the improvement of the standard of international review of the protection of the collective dimension of freedom of religion or belief. The book asks two main questions: what is the scope and nature of protection afforded to the collective dimension of freedom of religion or belief in international law, and, secondly, how does the protection of the collective dimension of freedom of religion or belief in Turkey compare and contrast to international standards? In doing so it seeks to identify how the standard of international review of the collective dimension of freedom of religion can be improved.
