Although the Right to Leave and Return (RLR) is a fundamental human right, each State has the sovereign right to regulate RLR in accordance with its own laws. In the case of China, the country's communist political system has significantly affected the development of RLR and the country's approach to it. As a rule, China's approach is restrictive. As part of its reform and 'opening up' policies, China has embarked on a range of reforms to liberalise RLR, but the reforms lack cohesion and focus, and remain restrictive. Given its past and its complex social and economic conditions, China may have some justifications for its approach, but on balance, has more to gain from adopting a more liberal approach. The issue of RLR in China is crucial both for the future of China, and for development of RLR in the world. "The Right to Leave and Return (RLR) and Chinese Migration Law" provides a comprehensive and systematic review of the RLR in international and Chinese migration law. It has been written on the basis of Chinese statutes pertinent to the RLR, also of relevant international instruments and key cases. It investigates RLR in international migration law and practice; analyses RLR in the context of China, and identifies its driving factors; investigates the conditions and practical concerns relevant to the protection of RLR; and concludes with recommendations on how the Chinese regulatory regime governing RLR can be improved.

Lacking a single immigration code, Chinese immigration law is widespread, encompassing a variety of laws, regulations and policies, some of which are internal and closed. There is also no immigration cases system. These factors have combined to make the study and understanding of the system difficult for those outside or unfamiliar with this area of Chinese law. To add to this complexity, since the reform and opening-up policy in 1978, Chinese immigration law has been experiencing significant change. In particular, that brought about by the acceptance of a market economy in 1991, and with access to World Trade Organization membership in 2001. Due to the dilation of the legislation, the issue of conflict between Chinese immigration law and other Chinese laws has become serious. This book provides a comprehensive, up-to-date, and readily-accessible reference to Chinese immigration law. It provides the necessary detail, insight and background information for a thorough understanding of this complex system. The book has been written on the basis of Chinese statutes while also including coverage of the relevant international instruments. The work draws on and compares Chinese and English language sources, making it an invaluable resource for both Chinese and non-Chinese readers alike.

International Migration Law written by Vincent Chetail and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2019-04-04 with Law categories.

International Migration Law provides a detailed and comprehensive overview of the international legal framework applicable to the movement of persons across borders. The role of international law in this field is complex, and often ambiguous: there is no single source for the international law governing migration. The current framework is scattered throughout a wide array of rules belonging to numerous fields of international law, including refugee law, human rights law, humanitarian law, labour law, trade law, maritime law, criminal law, and consular law. This textbook therefore cuts through this complexity by clearly demonstrating what the current international law is, and assessing how it operates. The book offers a unique and comprehensive mapping of this growing field of international law. It brings together and critically analyses the disparate conventional, customary, and soft law on a broad variety of issues, such as irregular migration, human trafficking, refugee protection, labour migration, non-discrimination, regional free movement schemes, and global migration governance. It also offers a particular focus on important groups of migrants, namely migrant workers, refugees, and smuggled migrants. It maps the current status of the law governing their movement, providing a thorough critical analysis of the various stands of international law which apply to them, suggesting how the law may continue to develop in the future. This book provides the perfect introduction to all aspects of migration and international law.

We are living in a world in which the visible and invisible borders between nations are being shaken at an unprecedented pace. We are experiencing a wave of international migration, and the diversity of migrants – in terms of how they identify, their external and self-image, and their participation in society – is increasingly noticeable. After the introduction of the Reform and Opening Up policy, over 10 million migrants left China, with Europe the main destination for Chinese emigration after 1978. This volume provides multidisciplinary answers to open questions: How and to what extent do Chinese immigrants participate in their host societies? What kind of impact is the increasing number of highly qualified immigrants from China having on the development and perception of overseas Chinese communities in Europe? How is the development of Chinese identity transforming in relation to generational change? By focusing on two key European countries, Germany and France, this volume makes a topical contribution to research on (new) Chinese immigrants in Europe.

Globalisation Migration And Health written by Andre M. N. Renzaho and has been published by World Scientific this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016 with Political Science categories.

"As globalisation gains momentum, international migration continues to divide opinion and polarise policy makers, politicians, and advocates. This polarisation has been reflected in research and publications, with pro-globalisation being pitched against anti-globalisation on the one hand, and an explosion of research on migration on the other. This book examines the interaction between the two and their impact on health for the first time, highlighting the myths and realities from an international, multi-disciplinary perspective. The book starts with an examination of the complex and multifaceted aspects of the globalisation phenomenon and its impact on population displacement and health, and concludes with a regional level analysis supported by country-specific examples. By highlighting common issues and differences across the globe, this book shows policy makers, political leaders, and international committees on migration the specificities of global migration and good practice across the world. Particular attention is paid to practical policy responses and governance as well as legal frameworks to manage the dynamics of migration, engage international institutions, and to maximise the benefits that internal and international migration bring."--
