The role and range of the American presidency has undergone significant changes in the twenty-first century, with George W. Bush, Barack Obama, Donald Trump, and now Joe Biden transforming the office in distinct ways. Many but not all of these changes stem from the numerous crises of this young century: 9/11 and the resulting war on terror, Hurricane Katrina, the Great Recession, the COVID-19 pandemic, and the social unrest of 2020. While crisis brings rapid change, there are other factors at work as well. Increased polarization has led presidents of both parties to press existing rules and norms to their limits in an attempt to accomplish more during their brief tenures. The result is a lot of policy and structural change in a short period, including new cabinet departments, new election rules, and significantly increased spending and debt, among other things. For the most part, these changes have occurred with little thought to what it all means for the functionality and stability of our democratic institutions and, consequently, our nation’s capacity to address the needs as well as the aspirations of the American people. The Bipartisan Policy Center’s Tevi Troy has brought together a group of presidential scholars and political experts to address these important issues and to reflect on how the presidency has changed and what it might mean for the future. Contributors include Elaine Kamarck (former aide to President Clinton), Jonathan Burks (former chief of staff to Speaker Paul Ryan), Kenneth Baer (former aide to presidents Clinton and Obama), and Kristen Soltis Anderson (Republican pollster and radio host).

Presidents have long invoked electoral mandates to justify the use of executive power. In Delivering the People’s Message, Julia R. Azari draws on an original dataset of more than 1,500 presidential communications, as well as primary documents from six presidential libraries, to systematically examine choices made by presidents ranging from Herbert Hoover in 1928 to Barack Obama during his 2008 election. Azari argues that Ronald Reagan’s election in 1980 marked a shift from the modern presidency formed by Franklin Delano Roosevelt to what she identifies as a more partisan era for the presidency. This partisan model is a form of governance in which the president appears to require a popular mandate in order to manage unruly and deeply contrary elements within his own party and succeed in the face of staunch resistance from the opposition party. Azari finds that when the presidency enjoys high public esteem and party polarization is low, mandate rhetoric is less frequent and employs broad themes. By contrast, presidents turn to mandate rhetoric when the office loses legitimacy, as in the wake of Watergate and Vietnam and during periods of intense polarization. In the twenty-first century, these two factors have converged. As a result, presidents rely on mandate rhetoric to defend their choices to supporters and critics alike, simultaneously creating unrealistic expectations about the electoral promises they will be able to fulfill.

US diplomacy is broken. As a result, the United States sits on the sidelines as the remainder of the world writes international law dealing with a host of vexing problems. The source of the dysfunction is domestic politics. Partisan polarization has rendered the domestic treaty process unworkable. Instead, presidents rely entirely on unilateral tools to complete their agreements, making them far weaker and less legitimate. Using a mixed-methods approach, Peake assesses the politics surrounding treaty ratification and the use of unilateral authority since World War Two, with a particular focus on the twenty-first century. He employs original data from 1949 through 2020, including 1,000 treaties and more than 3,000 executive agreements. The analysis provides case studies of the domestic politics of several recent international agreements, including on climate change, Iranian nuclear weapons, security in Iraq and Afghanistan, human rights, and the law of the sea.
