Russian novels, poetry and ballet put the country squarely in the European family of cultures and yet there is something different about this country, especially in terms of its political culture. What makes Russia different? Maxim Trudolyubov uses private property as a lens to highlight the most important features that distinguish Russia as a political culture. In many Western societies, private property has acted as the private individual’s bulwark against the state; in Russia, by contrast, it has mostly been used by the authorities as a governance tool. Nineteenth-century Russian liberals did not consider property rights to be one of the civil causes worthy of defending. Property was associated with serfdom, and even after the emancipation of the serfs the institution of property was still seen as an attribute of retrograde aristocracy and oppressive government. It was something to be destroyed – and indeed it was, in 1917. Ironically, it was the Soviet Union that, with the arrival of mass housing in the 1960s, gave the concept of private ownership a good name. After forced collectivization and mass urbanization, people were yearning for a space of their own. The collapse of the Soviet ideology allowed property to be called property, but not all properties were equal. You could own a flat but not an oil company, which could be property on paper but not in reality. This is why most Russian entrepreneurs register their businesses in offshore jurisdictions and park their money abroad. This fresh and highly original perspective on Russian history will be of great interest to anyone who wants to understand Russia today.

In one way or another, all environmental and natural resource problems associated with overexploitation or under provision of public goods, arise from incompletely defined and enforced property rights. As a result private decision makers do not consider or internalize social benefits and costs in their production or investment actions. The gap between private and social net returns results in externalities harmful effects on third parties: overfishing, excessive air pollution, unwarranted extraction or diversion of ground or surface water, extreme depletion of oil and gas reservoirs. These situations are all examples of the The Tragedy of the Commons. In this paper, I consider options for mitigating the losses of open access: common or group property regimes, government tax and regulation policy, more formal private property rights. I briefly summarize the problems and advantages of each option and describe why there has been move toward rights-based instruments in recent years: ITQ (individual transferable quotas), tradable emission permits, and private water rights. This article explores the tensions between China's newly privatized model of urban housing ownership and its socialist foundations. Through a combination of interviews and local research, the authors investigate the evolution of property ownership in Shanghai's architecturally-distinctive stock of historic housing, encompassing various architectural periods and styles (including leading examples of Art Deco), which have gone through periods of private ownership (pre-1949), gradual socialization (1949-1965), militant squatting and occupation (1966-1976), and now privatization (1977 to current). Originally single-family residences, many were gerrymandered into multi-family units, in which the original owner/resident was relegated a small portion of space, and the remainder divided (by governmental assignment or squatting) among other residents. Now that land values in Shanghai have risen, there is increased interest in selling or renovating these houses (which are located in key sites in central Shanghai) or redeveloping the sites. However, the rights to develop or transfer these properties remain complicated due to ongoing issues regarding the rights of the original owners versus later residents/squatters. In the face of this impasse, a dynamic known as “the tragedy of the commons” has developed in which none of the parties has assumed responsibility for maintaining and improving the buildings or their common areas. As these formerly majestic pre-1949 residences increasingly fall into disrepair, they become vulnerable to demolition and replacement by shiny, new complexes. Unfortunately, if events follow this path, Shanghai will lose a key part of its architectural character and flavor.
