Justice is a human virtue that is at once unconditional and conditional. Under favorable circumstances, we can be motivated to act justly by the belief that we must live up to what justice requires, irrespective of whether we benefit from doing so. But our will to act justly is subject to conditions. We find it difficult to exercise the virtue of justice when others regularly fail to. Even if we appear to have overcome the difficulty, our reluctance often betrays itself in certain moral emotions. In this book, Jiwei Ci explores the dual nature of justice, in an attempt to make unitary sense of key features of justice reflected in its close relation to resentment, punishment, and forgiveness. Rather than pursue a search for normative principles, he probes the human psychology of justice to understand what motivates moral agents who seek to behave justly, and why their desire to be just is as precarious as it is uplifting. This book shows that constitutional courts exercise direct and indirect power on political branches through decision-making. The first face of judicial power is characterized by courts directing political actors to implement judicial decisions in specific ways. The second face leads political actors to anticipate judicial review and draft policies accordingly. The judicial–political interaction originating from both faces is herein formally modeled. A cross-European comparison of pre-conditions of judicial power shows that the German Federal Constitutional Court is a well-suited representative case for a quantitative assessment of judicial power. Multinomial logistic regressions show that the court uses directives when evasion of decisions is costly while accounting for the government’s ability to implement decisions. Causal analyses of the second face of judicial power show that bills exposed to legal signals are drafted accounting for the court. These findings re-shape our understanding of judicialization and shed light on a silent form of judicialization.

In Concepts of Justice D. D. Raphael gives a philosophical survey of the development of the idea of justice. While the framework is historical, the aim is philosophical analysis and criticism.Part I begins with 'Ancient Roots': justice in the Bible, in Aeschylus' Oresteia, in the philosophers Plato and Aristotle, and among jurists and theologians in the Middle Ages. Part II, 'Modern Shoots', deals with philosophers from Hobbes to Rawls, and others of the modern age. Some of the writings considered will be unfamiliar to many readers, who will find that eminence as a political theorist is neither a necessary nor sufficient condition of significant thought about justice.Part III, 'Historical Fruits', draws some conclusions from the whole survey, pinning down the notion of fairness, and asking why this notion embraces apparently disparate ideas, notably 'merit' and 'need'. The developing role of justice and the emergence of novel features during the last three centuries is also discussed. Raphael does not assume that the theories of philosophers must reflect the thought and usage of people generally: some do while others are idiosyncratic, and a number of philosophers neglect the usage of the concept in the context of law. Criminal proceedings in which people can lose life, liberty, or reputation tell us a great deal about the character of any society. In Japan, it is prosecutors who wield the greatest control over these values and who therefore reveal most clearly the character of the Japanese way of justice. In this book, David T. Johnson portrays Japanese prosecutors at work; the social, political, and legal contexts that enable and constrain their actions; and the content of the justice thereby delivered. Johnson is the first researcher, Japanese or foreign, to gain access to the frontline prosecutors who charge cases and the backstage prosecutors who manage and direct them. He shows that prosecutors in Japan frequently harmonize to imperlatives of justice that Americans often regard as irreconcilable: the need to individualize cases alike. However, their capacity to correct offenders and to obtain contrite, complete confessions from criminal suspects. Johnson argues that this extreme reliance on confessions occasionally leads to extreme efforts to extract them. Indeed, much of the most disturbing prosecutor behavior springs directly or indirectly from the system's inordinate dependence on admissions of guilt. The major achievements of Japanese criminal justice are thus inextricably intertwined with its most notable defects, and efforts to fix the defects threaten to undermine the accomplishments. Clearly written and skillfully argued, this comparative analysis will be of interest to students of Japan, criminology, and law and society. In recent decades, scholars have tended to interpret what Job says about death in one of two ways. They interpret it either as part of the broader reading of death in the Old Testament, or by imposing Ancient Near Eastern mythological concepts upon the text disregarding its nature as part of the Old Testament’s wisdom tradition. Varunaj Churnai attempts to redress the latter interpretation and treats the book of Job, and its development and understanding of death, contextually. Churnai specifically looks at how Job presents the two faces of God: God’s wrathful face and God’s gracious face. Beyond Justice demonstrates that the retribution principle allows humans to know the hidden God as it illuminates the relationship between individual and Creator. Through Job’s experiences and heartfelt outpouring of his soul before both God’s wrathful face and God’s gracious face we can know God more fully. Churnai shows how these faces of God are reconciled in the two divine speeches of YHWH, which invite both Job and the reader to move beyond retribution theology to trust in the graciousness of God.
