The United Nations’ Universal Declaration of Human Rights in 1948 proclaimed a vision of freedom of expression exercised regardless of frontiers. Nonetheless, laws and norms regarding the freedom or limits of expression are typically established and understood at the national level. In today’s interconnected world, newfound threats to free expression have suddenly arisen. How can this fundamental right be secured at a global level? This volume brings together leading experts from a variety of fields to critically evaluate the extent to which global norms on freedom of expression and information have been established and which actors and institutions have contributed to their diffusion. The authors also consider ongoing and new challenges to these norms, from conflicts over hate speech and the rise of populism to authoritarian governments, as well as the profound disruption introduced by the internet. Together, the essays lay the groundwork for an international legal doctrine on global freedom of expression that considers issues such as access to government-held information, media diversity, and political speech. As the world risks renouncing previous commitments to the freedom of expression, Regardless of Frontiers serves as a timely reminder of just how much is at stake and what needs protecting.

Bachelor Thesis from the year 2009 in the subject Politics - International Politics - Region: South Asia, grade: 5,5 (Schweizer System), University of St. Gallen, course: International Affairs , language: English, abstract: Freedom of speech is considered to be a counter stone for democracy and development. This paper aims to contribute to the discussion on the topic of freedom of speech, with a special focus on China and South‐ East Asia. To approach this topic, first of all, an overview of the topic of human rights will be presented, and an examination of the principle of universality of human rights will be made. Secondly, a closer consideration of freedom of speech will be presented. After this, the United Nations and their relation to human rights will be reviewed and the topic of the universality of the UN human rights system will be analyzed. Furthermore, the most important organs and treaties considering human rights within the United Nations System will be introduced. It is also important to take a look at the current situation of human rights in general and freedom of speech in particular in China and South‐ East Asia. In the end, two policy recommendations, one concerning South‐ East Asia and one concerning China, on what the United Nations can do to support and promote freedom of speech in these regions, will be made. These two recommendations will be slightly different for the two regions, mainly due to the position of China within the United Nations. While the recommendation for South‐ East Asia can be made (almost) within the human rights framework of the United Nations, the recommendation for China has to focus on socalled soft power measures.

Free Speech Religion And The United Nations written by Heini í Skorini and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2019-07-19 with Political Science categories.

This book explores the political struggle to interpret and define the meaning, the scope and the implications of human rights norms in general and freedom of expression in particular. From the Rushdie affair and the Danish cartoon affair to the Charlie Hebdo massacre and draconian legislation against blasphemy worldwide, the tensions between free speech ideals and religious sensitivities have polarized global public opinion and the international community of states, triggering fierce political power struggles in the corridors of the UN. Inspired by theories of norm diffusion in International Relations, Skorini investigates how the struggle to define the limits of free speech vis-à-vis religion unfolds within the UN system. Revealing how human rights terminology is used and misused, the book also considers how the human rights vision paradoxically contains the potential to justify human rights violations in practice. The author explains how states exercise power within the field of international human rights politics and how non-democratic states strategically apply mainstream human rights language and secular human rights law in order to justify authoritarian religious censorship norms both nationally and internationally. This interdisciplinary book will appeal to scholars and students researching international human rights, religion and politics. The empirical chapters are also relevant for professionals and activists within the field of human rights.

European Convention on Human Rights – Article 10 – Freedom of expression 1. Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers. This article shall not prevent States from requiring the licensing of broadcasting, television or cinema enterprises. 2. The exercise of these freedoms, since it carries with it duties and responsibilities, may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society, in the interests of national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or rights of others, for preventing the disclosure of information received in confidence, or for maintaining the authority and impartiality of the judiciary. In the context of an effective democracy and respect for human rights mentioned in the Preamble to the European Convention on Human Rights, freedom of expression is not only important in its own right, but it also plays a central part in the protection of other rights under the Convention. Without a broad guarantee of the right to freedom of expression protected by independent and impartial courts, there is no free country, there is no democracy. This general proposition is undeniable. This handbook is a practical tool for legal professionals from Council of Europe member states who wish to strengthen their skills in applying the European Convention on Human Rights and the case law of the European Court of Human Rights in their daily work.
