What would an alternative to contemporary capitalism look like? In this book, Geert Reuten sets out a detailed design of a democratic society organised in worker cooperatives, followed by an equally detailed democratic transition to it, thereby making a convincing case. In Reuten’s design, Workers constitute the single economic class. However, unlike in capitalism, there is no class that owns the means of production. The legal structure of worker cooperatives is such that workers have full rights to the fruits of the cooperative without owning it, and yet the state does not own the cooperatives either. Interestingly, worker councils in the economic and state domains vote on all economically relevant matters. In Reuten’s work, the free choice of occupation and of specific consumer goods is even larger than in capitalism.

Despite the reversal of America’s fortune from the triumphalism of the Roaring Nineties to the gloom of the lost decade and the Great Depression, theoretical conceptions of US capitalism have remained surprisingly unchanged. In fact, if the crisis questioned the sustainability of the US capitalist paradigm, it did not fundamentally challenge academic theorization of American political economy. This book departs from the American political economy literature to identify three common myths that have shaped our conceptualization of US capitalism: its reduction to a state-market dyad dis-embedded from societal factors; the illusion of a weak state and the synchronic conception of the US variety of capitalism. To remedy these pitfalls, the authors propose a civilizational approach to American political economy at the crossroads between cultural studies, history, sociology and political science. Drawing together contributions from a rich variety of fields (from geography to cultural studies, political science and sociology) this work sheds a new light on America’s "cultural political economy" combining theoretical reflection with empirical data and offering innovative perspectives on the crisis and renewal of American capitalism.

Following the 100th anniversary of Pashukanis’ General Theory of Law and Marxism (1924), this volume aims to breathe new life into the main category of Pashukanian legacy, the concept of legal form. This book offers new, deeper and more general, ways in which the concept of legal form can be used to push forward Marxist – post-Marxist or hauntingly Marxist – legal theory. Accordingly, this book does not pledge allegiance to reconstructing and reconsidering the official interpretative legacy of the legal form. Instead, it mobilises the revolutionary conceptual potentialities that this term contains. When investigated thoroughly, and in many dimensions, the legal form becomes a privileged vantage point not only into the greatest law-related riddles of Marxism (such as the relation between economy and the state or withering away of statal apparatuses), but the whole of modernity as the epoch determined by – if not overlapping with – capitalism. This book aims to think with the legal form rather than explain this concept. In so doing, it offers a panoply of theoretical perspectives that address legal subjectivity, abstraction, autonomy of the law and, last but not least, withering away of the law. This contemporary interrogation of the relevance of the concept of legal form will be of considerable interest to scholars and students of legal and political theory.
