All those issues, now regarded as unquestionably wrong in the Western Hemisphere, were often based on arguments of manifested differences between people. Even though people are still as different in characteristics, endowment and lifestyle as they ever have been, the attitude of many societies towards those topics drastically changed over the last centuries. There must be some significant reasons to regard humans now as fundamentally equal although they are dissimilar in so many ways. The question is still a fascinating one: Is it therefore justified to treat all people equally and is that a goal worth achieving? It is legitimate to consider people equal in certain areas whilst unequal in others. I will argue that there are good reasons to treat people equally as they are equal in some respects and treat them unequally because they are unequal in others but also to treat people equally although they are unequal. However for this purpose my essay will be organized in three sections. In the first passage I will defend equality of rights, equality before the law and equality in politics, backed up by the principle of Equality of Respect or Universal Humanity. Starting of with equality of resources in the second part, I will also examine equality of happiness and welfare. In the third paragraph the debate over equality of opportunity and equality of a basic living standard marks the end of my discussion. [...]

"Although thinkers of the past might have started from presumptions of fundamental difference and inequality between (say) the genders, or people of different races, this is no longer the case. At least in mainstream political philosophy, we are all now presumed to be, in some fundamental sense, basic equals. Of course, what follows from this putative fact of basic equality remains enormously controversial: liberals, libertarians, conservatives, Marxists, republicans, and so on, continue to disagree vigorously with each other, despite all presupposing some kind of basic equality. They may argue about who gets what, how much, and why, but the starting point - that all people are in some sense deserving of prima facie equal consideration - has become an axiom of our moral and political thinking. But why? Why are we basic equals? The trouble is that as soon as one asks for an explanation of this foundational premise, it begins to look shaky. After all, on any conceivable metric human beings are notably unequal, and often to striking degrees. Philosophers in this area tend to talk of equal worth, but often without trying to specify what exactly that means. Philosophically, basic equality is neither acceptable nor rejectable. It is not rejectable because we appear to be, as a matter of fact, profoundly committed to the truth of the claim that we are all one another's basic equals. But to the extent that there appear to be no philosophical arguments for believing in the truth of basic equality, it is not acceptable either. The aim of this book is to try and show why basic equality is acceptable. To do so, however, it will also contend that we need to approach the question rather differently to how it has mostly been handled so far. What's required is an exercise in what Bernard Williams called 'impure philosophy': it must include insights from other areas of human intellectual endeavour, whether psychology and history or even what we learn from how we go about practicing basic equality in our collective lives"--

Age structures our social fabric - our institutions, relationships, obligations, and entitlements. There is an age for voting, an age for working, and an age when one is expected (and sometimes required) to retire. Each stage of life also brings with it specific forms of social risks andvulnerabilities. Consequently, numerous and multidimensional inequalities arise between age groups. How should we respond to these inequalities? Are they akin to gender or racial disparities? Or is there something distinctive about age that mitigates the need for concern?Justice Across Ages answers these questions and proposes a theory of justice between age groups and co-existing generations. Written at the intersection of philosophy and public policy, the book explores the principles that should guide a fair distribution of goods like jobs, healthcare, income, andpolitical power among people at different stages of their life. It draws upon a range of cases to develop normative tools that help distinguish objectionable inequalities from acceptable ones and explores a variety of policy remedies.Like many political philosophers have, it may be tempting to assume that, since people experience the social position of different age groups throughout their lives, all that matters is that persons are equal over their complete lives. This book shows that we should resist this view and makes theproposition that many diachronically 'equal' arrangements are in fact unjustly unequal. In particular, we should view with suspicion many widely tolerated forms of age-based social hierarchies, such as the infantilization of young adults and older citizens, the political marginalization of teenagersand young adults, the exploitation of young workers through precarious contracts and unpaid internships, and the spatial segregation of elderly persons. If we ever are to live in a society that treats its members as equals, we need to pay attention to how age membership can alter our socialstanding. This view has important implications for how we should think of the political and moral value of equality, for how our social and political institutions should be designed, and also for how we should conduct ourselves in a range of contexts including the family, the workplace, and theuniversity classroom.

The constitutionalization of intellectual property law is often framed as a benign and progressive integration of intellectual property with fundamental rights. Yet this is not a full or even an adequate picture of the ongoing constitutionalization processes affecting IP. This collection of essays, written by international experts and covering a range of different areas of intellectual property law, takes a broader approach to the process. Drawing on constitutional theory, and particularly on ideas of "new constitutionalism", the chapters engage with the complex array of contemporary legal constraints on intellectual property law-making. Such constraints arising in international intellectual property law, human rights law (including human rights protection for right-holders), investment treaties, and forms of private ordering. This collection aims to illuminate the complex role of this constitutional framework, by analysing the overlaps, complementarities, and conflicts between such forms of protection and seeking to establish the effects that this assemblage of global and regional norms has on legal reform projects and interpretations of IP law. Some chapters take a broad theoretical perspective on these processes. Others focus on specific situations in which the relationship between intellectual property law and broader constitutional norms is significant. These contexts range from Art 17 of the EU's Digital Single Market Directive, to the implementation of harmonized trade secrets protection, from the role of Canada's Charter of Rights to the impact of the social model of property in Brazil.
