This book explores the idea of responsible government in East Asia, arguing that many recent governance crises have resulted from responsibility failures on a huge scale. It distinguishes between accountability, which it argues has been overemphasised recently, and responsibility, which it argues goes beyond accountability, true responsible government involving the actor in feeling liable for and taking responsibility for his or her actions. It shows how historically the concept of responsibility is more embedded in political discussions in Asia, whereas the concepts of democracy and accountability are more embedded in the intellectual traditions of Europe, but that the challenges of revolution and post-revolution, decolonization and post-colonization and neo-liberal globalization have complicated matters. Drawing on a wide range of case studies from East Asia, and relating the concepts discussed to political theory, ethics and social psychology, the book shows how actors in government and society interact to deliberate, produce or distract from the practice and perception of “responsible government”, and suggests how the concept of “responsible government”, better defined, might be encouraged to produce better governance.

Australia's engagement with Asia from 1944 until the late 1960s was based on a sense of responsibility to the United Kingdom and its Southeast Asian colonies as they navigated a turbulent independence into the British Commonwealth. The circumstances of the early Cold War decades also provided for a mutual sense of solidarity with the non-communist states of East Asia, with which Australia mostly enjoyed close relationships. From 1967 into the early 1970s, however, Commonwealth Responsibility and Cold War Solidarity demonstrates that the framework for this deep Australian engagement with its region was progressively eroded by a series of compounding, external factors: the 1967 formation of ASEAN and its consolidation by the mid-1970s as the premier regional organisation surpassing the Asian and Pacific Council (ASPAC); Britain's withdrawal from East of Suez; Washington's de-escalation and gradual withdrawal from Vietnam after March 1968; the 1969 Nixon doctrine that America's Asia-Pacific allies must take up more of the burden of providing for their own security; and US rapprochement with China in 1972. The book shows that these profound changes marked the start of Australia's political distancing from the region during the 1970s despite the intentions, efforts and policies of governments from Whitlam onwards to foster deeper engagement. By 1974, Australia had been pushed to the margins of the region, with its engagement premised on a broadening but shallower transactional basis.

Contemporary East Asian societies are still struggling with complex legacies of colonialism, war and domination. Years of Japanese imperial occupation followed by the Cold War have entrenched competing historical understandings of responsibility for past crimes in Korea, China, Japan and elsewhere in the region. In this context, even the impressive economic and cultural networks that have developed over the past sixty years have failed to secure peaceful coexistence and overcome lingering attitudes of distrust and misunderstanding in the region. This book examines the challenges of historical reconciliation in East Asia, and, in doing so, calls for a reimagining of how we understand both historical identity and responsibility. It suggests that by adopting a ‘forward-looking’ approach that eschews obsession with the past, in favour of a reflective and deliberative engagement with history, real progress can be made towards peaceful coexistence in East Asia. With chapters that focus on select experiences from East Asia, while simultaneously situating them within a wider comparative perspective, the contributors to this volume focus on the close relationship between reconciliation and ‘inherited responsibility’ and reveal the contested nature of both concepts. Finally, this volume suggests that historical reconciliation is essential for strengthening mutual trust between the states and people of East Asia, and suggests ways in which such divisive legacies of conflict can be overcome. This book is the second volume of a planned trilogy on legal protection of citizens' rights against the state in East and Southeast Asia. The first volume was published in 1997, under the title of "Comparative Studies on the Judicial Review System in East and" "Southeast Asia." The third book will deal with the subject of due process of law with respect to administrative decision-making in these areas. This second volume examines the historical development and present function of governmental liability in Japan, China, Korea, Taiwan, Malaysia and Indonesia. Both theoretical and practical problems of governmental liability are analyzed through comparative perspectives. As German and Dutch law have a strong influence in East and Southeast Asian countries, the governmental liability system in these two countries is also discussed. During the process of modernizing the economy and legal systems, especially with the globalization of the economy and the internationalization of Western law, it is inevitable for countries in East and Southeast Asia to introduce a governmental compensation system. However, because of a lack of experience of civil society and the tradition of the rule of law, of shortage of finance, and of different viewpoints on human rights, the introduced and planned governmental compensation systems in East and Southeast Asia could not be expected to function in the same way as those in Western countries. This book is based on the assumption that it is better to prevent damage from happening than compensating for it with money.
