The introduction by the Amsterdam Treaty of the flexibility clauses, authorising a majority of Member States to cooperate more closely in areas covered by the Treaties, has been received with mixed feelings. Flexibility is by no means a new phenomenon in the EU's development. It has been on the Community's agenda already since the 1970s. The Single European Act introduced several provisions allowing for flexible approaches to the single market, whilst the Maastricht Treaty launched a differentiated approach to the EMU and social policy. In addition to these forms of differentiation in primary Community law, for many years there has also been a number of quite important, though less visible, forms of differentiation in secondary Community law. This book aims to link both levels of differentiation and seeks to unveil the many faces of differentiation in EU law. It analyses whether, and to which extent, there is a shift in European integration from a system of unity and uniformity to one of flexibility and differentiation. A first series of contributions to the book analyse a number of exemplary policy fields (EMU, social policy, environment, free movement of persons, justice and home affairs) in order to identify their degree of differentiation. A second set of contributions examine various 'horizontal' institutional matters of cross-sectoral importance. These two main parts are framed by introductory articles on the development of flexibility and by contributions drawing on the constitutional limits to differentiation. Virtue ethics is now widely recognized as an alternative to Kantian and consequentialist ethical theories. However, moral philosophers have been slow to bring virtue ethics to bear on topics in applied ethics. Moreover, environmental virtue ethics is an underdeveloped area of environmental ethics. Although environmental ethicists often employ virtue-oriented evaluation (such as respect, care, and love for nature) and appeal to role models (such as Henry Thoreau, Aldo Leopold, and Rachel Carson) for guidance, environmental ethics has not been well informed by contemporary work on virtue ethics. With Character and Environment, Ronald Sandler remedies each of these deficiencies by bringing together contemporary work on virtue ethics with contemporary work on environmental ethics. He demonstrates the many ways that any ethic of character can and should be informed by environmental considerations. He also develops a pluralistic virtue-oriented environmental ethic that accommodates the richness and complexity of our relationship with the natural environment and provides effective and nuanced guidance on environmental issues. The purpose of this volume is to demonstrate how contemporary institutional economic analysis can be applied to the resolution of economic problems. The general literature of institutional economics is unorthodox, beginning with its methodological foundations and continuing through the kind of policy analysis found in these pages. The orthodox tradition in economics is commonly characterized as "neoclassical economics." Neoclassical economics fosters the myth that only "the market" can efficiently allocate a society's economic resources and equitably distribute its income. It provides the intellectual defense for in which "free markets" are championed over democratic capitalist ideology policy formation, which it contends is neither efficient nor equitable. For both professional economists and policy makers of a conservative political persuasion, neoclassical economics writes the script for a morality play in which the market is the "good guy" and the government is the "bad guy." The archipelago of the Philippines is well endowed with nonferrous mineral resources, and in recent years the Philippine government, acting under the influence of the dominant and seemingly ubiquitous neoliberal development paradigm, has liberalized its mining laws in order to accelerate economic development. Yet the Philippines is also a country highly prone to a variety of natural hazards that have the ability to interact adversely with mining’s potential for environmental degradation. Thus there are great dangers inherent in pursuing such a development paradigm: earthquakes can destabilize tailings storage facilities, typhoons can flood tailings ponds, and mine-pit dewatering can enhance the competition for groundwater resources during droughts. This study explores how these hazards amplify the environmental harm prevalent in mining, and reveals the substantial threat posed to the livelihoods of the archipelago’s poor, as well as the inadequacies of the very institutions designed to protect their environment.
