It has been widely accepted that trafficking of human beings is a human rights issue. However, it has been difficult to address the human rights aspects of the phenomenon in practice, because a comprehensive analysis of applicable human rights norms and principles has not been fully developed, and therefore the nature of obligations imposed upon States is not entirely clear. The purpose of this book, then, is to establish a human rights framework to promote better understanding of the multi-faceted problems inherent in trafficking of human beings, articulate obligations imposed upon States, and facilitate a holistic approach. The book also contains chapters on case studies at the national, regional, and international levels, thereby combining the theory and practice.

This unique publication sets out the legal framework and practice at national level with regard to human trafficking, including the changes brought about as a result of the UK ratification of the Council of Europe Convention on Action against Trafficking in Human Beings. Human Trafficking - Human Rights: law and practice will be of great use not just to practitioners, advisers and policy-makers working directly with victims of trafficking but also to the non-specialist practitioners who encounter trafficked persons and would like to know how best to help them. Trafficking in human beings has become a major problem in the UK with an increasing number of people, the vast majority of them women and children, from impoverished parts of the world falling victim to trafficking for the purposes of sexual or other exploitation. The victims of trafficking regularly find themselves in a perilously vulnerable situation, often facing coercion and violence, unprotected by employment law safeguards and fearful of attempting to get help from the relevant authorities. Human Trafficking - Human Rights: law and practice sets out to explain and discuss issues of theory such as definitions of legal terminology but goes further, providing invaluable practical guidance on how to assist victims. Covering both the use of civil law as well as criminal law, it provides helpful advice on how to deal with the identification of victims and how best to use national referral systems.

This book provides a short, comprehensive, critical analysis of trafficking in human beings. Despite the size and scope of this criminal activity, there remains a need for an accurate, objective, contemporary examination of this threat as the nature of this crime and the strategies developed to counter it are fluid. Trafficking harms not only the lives of those trafficked but equally families and communities, as well as national economies and social cohesion. As this crime spans the spectrum of social science disciplines and fields of study, together with its increasing exposure in the media, this has led to a sharp increase in interest in this topic within the academic community and amongst policy makers, criminal justice practitioners and the wider public. This book draws on current research, the authors’ expert knowledge and insight into current counter-trafficking practices to provide a critical analysis of the crime and strategies to counter its prevalence.

In the aftermath of four Yugoslav wars, ongoing efforts at reconstruction in South Eastern Europe have devoted relatively limited attention to dimensions of human security that enhance protections for the region's most vulnerable populations in their daily lives. It is in this context that South Eastern Europe, and especially the Western Balkan region, has emerged as a nexus point in human trafficking. Human Trafficking, Human Security, and the Balkans brings together leading scholars, NGO representatives, and government officials to analyze and offer solutions to this challenge. The contributors explore the economic dynamics of human trafficking in an era of globalization, which has greatly facilitated not only the flow of goods and services but also the trade in human beings. They also examine the effectiveness of international and transnational policies and practice, the impact of peacekeeping forces, and the emergence of national and regional action plans in the Western Balkans and, more broadly, in South Eastern Europe. Finally, they consider the nature and ramifications of the gap between human security rhetoric and institutional policy steps against human trafficking.

Trafficking in persons is a serious crime that affects the human rights, dignity and integrity of all its victims including women, men, and children in the Association of Southeast Asia Nation (ASEAN) region. ASEAN has made efforts to fight human trafficking through inter alia the establishment of regional counter-human trafficking laws and human rights bodies to establish best norms and practices for its member countries. Nevertheless, the International Labour Organization (ILO) recently declared that there are more than 11.7 million forced labor victims in the Asia-Pacific region encompassing the biggest concentration of forced labour victims in the world. This volume reviews the achievements and the deficiencies of ASEAN’s counter-human strategies at the national and regional level. It offers suggestions for the reform of ASEAN's anti-trafficking laws and for the creation of a regional anti-trafficking human rights body specialized in preventing human trafficking, promoting equal protection of all trafficking victims, and prosecuting human traffickers.

The last few decades have seen a huge increase in attention paid to the trafficking of human beings, often referred to as modern-day slavery. International and national policies and protocols have been developed and billions of dollars spent to combat the issue and protect trafficking victims. Yet it continues to flourish and human beings, in both the Global North and the Global South, continue to be degraded to the level of commodities and smuggled across borders for profit. Drawing upon feminist and human rights approaches to trafficking, this book links the worlds of policy, protocols, and social structures to the lived experience and conditions of trafficked people. Recognizing that trafficking for sex, labor, and body parts often overlaps in a broader context shaped by poverty, violence, and shrinking access to rights, the authors offer a more thoroughgoing account of this social problem. Only with such an integrated approach can we understand the exploitative conditions that make people vulnerable to trafficking, and the progress – as well as gaps – in initiatives seeking to address it.
