Na sociedade mundial atual, problemas constitucionais persistem e ultrapassam os territórios dos Estados, especialmente relativos a direitos humanos e fundamentais. Diante disso, surge o transconstitucionalismo como um constitucionalismo relativo a (soluções de) problemas jurídico-constitucionais; um constitucionalismo independente de constituição. A partir daí se busca, como principal objetivo desse livro, a observação da proteção ao direito à saúde no Sistema Interamericano de Direitos Humanos. Dessa forma, o autor traz a seguinte problematização: a proteção ao direito à saúde é prejudicada pela ausência do transconstitucionalismo no Sistema Interamericano de Direitos Humanos? Em busca de responder tal questionamento, a obra foi separada em três capítulos. O primeiro sendo complemente teórico, para buscar entender a teoria (do transconstitucionalismo). No segundo capítulo está o teor principal da obra, é feita a observação de nove casos da Corte Interamericana de Direitos Humanos, com um viés empírico metodológico. E para finalizar, o terceiro capítulo destaca a observação das consequências da ausência do transconstitucionalismo entre Cortes no caso do direito à saúde no Sistema Interamericano de Direitos Humanos. À vista disso, inicialmente, partiu-se do pressuposto da ausência do transconstitucionalismo nos casos da Corte Interamericana. No entanto, no decorrer do livro, será verificado o contrário. A compreensão da necessidade de diálogos e entrelaçamento de ordens jurídicas na proteção do direito à saúde é fundamental para a sua evolução. Consequentemente, mesmo não sendo capaz de levar a uma unidade constitucional do sistema jurídico mundial, o transconstitucionalismo é uma forma mais eficaz de dar respostas a problemas que ultrapassam fronteiras estatais e que emergem fragmentariamente no contexto da sociedade atual.

Transconstitutionalism is a concept used to describe what happens to constitutional law when it is emancipated from the state, in which can be found the origins of constitutional law. Transconstitutionalism does not exist because a multitude of new constitutions have appeared, but because other legal orders are now implicated in resolving basic constitutional problems. A transconstitutional problem entails a constitutional issue whose solution may involve national, international, supranational and transnational courts or arbitral tribunals, as well as native local legal institutions. Transconstitutionalism does not take any single legal order or type of order as a starting-point or ultima ratio. It rejects both nation-statism and internationalism, supranationalism, transnationalism and localism as privileged spaces for solving constitutional problems. The transconstitutional model avoids the dilemma of 'monism versus pluralism'. From the standpoint of transconstitutionalism, a plurality of legal orders entails a complementary and conflicting relationship between identity and alterity: constitutional identity is rearticulated on the basis of alterity. Rather than seeking a 'Herculean Constitution', transconstitutionalism tackles the many-headed Hydra of constitutionalism, always looking for the blind spot in one legal system and reflecting it back against the many others found in the world's legal orders.

A presente investigação desenvolve-se em três capítulos. O primeiro estuda a racionalidade e a razão transversal na obra de Wolfgang Welsch e algumas dimensões da teoria dos sistemas em Niklas Luhmann e Gunther Teubner no intuito de testar os pressupostos teóricos da brilhante tese do jurista Marcelo Neves. O segundo capítulo discute a teoria da interconstitucionalidade, formulada a partir da experiência constitucional europeia. Posteriormente, é realizado um estudo sobre o paradigma de rede de François Ost e Michel Kerchove. Por fim, são analisadas como seriam as relações transconstitucionais entre as ordens jurídicas. O terceiro capítulo estuda o transconstitucionalismo no âmbito do sistema interamericano de direitos humanos, a partir da jurisprudência sobre as leis de anistia e de autoanistia. Também há uma tentativa de recorte do direito à memória, levando-se em consideração a jurisprudência da Corte Interamericana e a atuação de algumas comissões da verdade. Ao final, são apresentados alguns pontos de partida para a formulação da ideia da transjusfundamentalidade. Quando Ulrich Becker estabelece a distinção entre princípios e instituições fundamentais da modernidade, leciona que os "inimigos da modernidade" utilizam-se frequentemente das instituições básicas da modernidade, a saber: organização burocrática, lei, "legitimação democrática" do poder e monopólio da violência. Por sua vez, Luhmann explica que os juristas, geralmente, pensam que a violação da norma somente pode ocorrer se ela já existir. Por outro lado, os sociólogos e antropólogos conseguem vislumbrar o oposto: a violação da norma ocorre quando legítimas expectativas são frustradas. Esta leitura exemplar contribui imensamente, sobretudo, nas ações e omissões anti-humanas e penalmente relevantes de determinados "officials" em tempos da COVID-19, nos casos de tortura nos "porões da ditadura" por crimes políticos, contribui igualmente para as graves violações da segurança nuclear, nos crimes ambientais, nos imprescritíveis crimes contra a humanidade e de guerra. E não se trata fundamentalmente de questões de consciência ou de respeito moral, mas certamente de uma espécie de direito para o qual buscamos possíveis sanções.

The majority of citizens in the world today do not trust their political representatives, the mainstream political parties, the established political institutions or their governments. We live in a world that is increasingly difficult to understand. It is not just changing: it is metamorphosing. Change implies that some things change but other things remain the same capitalism changes, but some aspects of capitalism remain as they always were. Metamorphosis implies a much more radical transformation in which the old certainties of modern society are falling away and something quite new is emerging. To grasp this metamorphosis of the world it is necessary to explore the new beginnings, to focus on what is emerging from the old and seek to grasp future structures and norms in the turmoil of the present. Take climate change: much of the debate about climate change has focused on whether or not it is really happening, and if it is, what we can do to stop or contain it. But this emphasis on solutions blinds us to the fact that climate change is an agent of metamorphosis. It has already altered our way of being in the world the way we live in the world, think about the world and seek to act upon the world through our actions and politics. Rising sea levels are creating new landscapes of inequality drawing new world maps whose key lines are not traditional boundaries between nation-states but elevations above sea level. It is creating an entirely different way of conceptualizing the world and our chances of survival within it. The theory of metamorphosis goes beyond theory of world risk society: it is not about the negative side effects of goods but the positive side effects of bads. They produce normative horizons of common goods and propel us beyond the national frame towards a cosmopolitan outlook.
