Transformative Property Law honours Professor AJ Van der Walt (1956-2016) - scholar, mentor, and teacher. As the first incumbent of the DST/NRF South African Research Chair in Property Law his primary research goal was to develop the theoretical foundations for the transformation of property law in post-apartheid South Africa. Transformative Property Law consists of 20 essays by a combination of senior and young scholars from South Africa, the United States of America, the United Kingdom, Ireland, the Netherlands, Belgium, and Zimbabwe. The essays focus on the themes that Professor Van der Walt developed during the first 10 years of the research chair, namely: (a) the single system of law and subsidiarity principles; (b) the marginality principle; (c) the development of the common law of property; (d) constitutional property law; and (e) property theory. This volume also includes a list of all Professor Van der Walt's research outputs and a list of all the Masters and Doctoral students that he supervised during his career. Transformative Property Law covers topics that are on the forefront of global thinking on property law and will be a valuable resource for subject specialists, researchers, advanced students, practitioners and the judiciary alike. Juta's Property Law Library is aimed at revisiting and reassessing the whole of South African property law, which includes uncodified common law that is mostly embodied in case law, academic writing and legislation, to establish: - how each aspect of property law was influenced by apartheid law; - its response to the new constitutional dispensation (including land reform), and; - whether it can make a contribution towards the transformation of South African law and society. Having its origins in the process of transformation and land reform that began to take shape in South Africa at the end of the last century, this strikingly original analysis of property starts from deep inside the property regime and not from a distant or abstract perspective on property rules and practices. Focusing on issues of stability and change in a transformative setting and on the role of tradition and legal culture in that context, the book argues that a property regime, including the system of property holdings and the rules and practices that entrench and protect them, tends to insulate itself against change through the security- and stability-seeking tendency of tradition and legal culture, including the deep assumptions about security and stability embedded in the rights paradigm, rhetoric and logic that dominate current legal culture. The rights paradigm tends to stabilise the current distribution of property holdings by securing extant property holdings on the assumption that they are lawfully acquired, socially important and politically and morally legitimate. This function of the rights paradigm tends to resist or minimise change, including change brought about by morally, politically and legally legitimate and authorised reform or transformation efforts. The author's goal is to gauge the lasting power of the rights paradigm by investigating its effects in the margins of property law and of society, by establishing the actual efficacy and power of reformist or transformative anti-eviction policies and legislation aimed at the protection of marginalised and weak land users and occupiers in areas such as landlord-tenant law, eviction of unlawful occupiers of land and other restrictions on the landowner's power to enforce a stronger right to exclusive possession. Ultimately the book's aim is to explore the possibility of opening up theoretical space where justice-inspired changes to (or transformation of) the extant property regime can be imagined and discussed more or less fruitfully from an unusual perspective, a perspective from the margins which is valuable for any theoretical consideration or discussion of property.

The law of property provides the building blocks for our market economy and is a manifestation of our post French and American Revolution thinking on how we want to organise ourselves. That organisational structure has not always been fair or equal around the world. European property law systems have been exported around the globe, yet outside of Europe things have been possible, such as owning another person (slavery) or extracting wealth from land at all costs. This was unthinkable on the European continent. These differences have led to an increasingly unequal division of property between people, countries and even continents. Some can extract a lot of wealth and pollute the planet from their property, whilst others have nothing. An unsustainable use of the planet's resources where we live outside of our planetary boundaries is the result. This short book argues thatthis is notthe way forward. Ourlaw must be resilientin a transformative manner and European systems need to accept their role in how this has come to be. Based on that, we need to rethink how we can reform our law of property so that it allows us to live within our planetary boundaries.
