SÉVERINE DENEULIN, MATHIAS NEBEL AND NICHOLAS SAGOVSKY TRANSFORMING UNJUST STRUCTURES The Capability Approach THE CAPABILITY APPROACH Structural injustice has traditionally been the concern of two major academic disciplines: economics and philosophy. The dominant model of economics has long been that of neo-classical economics. For neo-classical economists, human we- being is to be assessed by the availability of disposable income or according to goods consumed; it is measured by the levels of utility achieved in the consumption of commodities. Social order is fashioned by the ways consumers maximise their 1 well-being and enterprises maximise their profits. A core assumption is that all 2 commodities are commensurable: they can all be measured according to a single 3 numerical covering value, which is their price. Within this neo-classical paradigm, justice is achieved when the utility level of someone cannot be increased without 4 another person seeing his or her utility level decrease. The dominant paradigm of neo-classical economics was strongly challenged when development and welfare economist Amartya Sen received the Nobel Prize for Economics in 1998. His work offered an alternative to the neo-classical evaluation of human well-being in the utility/commodity space. The underlining philosophical intuition behind Sen’s work is that the standard of living lies in the living and not in the consumption of commodities. In searching for an alternative measure of human well-being, Sen devised his capability approach.

Over the last few decades, the issue of historical/ non-recent institutional abuses has resonated in a range of Western states and churches. Despite the recent proliferation of 'justice' responses to such abuses including prosecutions and civil litigation, inquiries, redress and apologies, it is a subject which is insufficiently understood in the literature. Set against the complexities of the legal, historical, cultural, and political realities of addressing non-recent institutional abuses, Transforming Justice Responses to Non-Recent Institutional Abuses critically examines these justice responses across Northern Ireland and the Republic of Ireland. Bringing together the voices of victim/survivors of non-recent institutional abuses with legal actors, academics, media professionals, and church and state actors on their experiences of justice processes, this book reframes discourses on accountability and responsibility and considers how to improve justice processes at the level of praxis and increase engagement between victim/survivors and institutional actors. Drawing on interdisciplinary literature related to restorative, transitional, and transformative justice and analysis of primary research, the book advances analysis of the role of innovative justice in this space and a new approach to justice which bridges the accountability gap between seeking and achieving justice for non-recent institutional abuses while improving outcomes for victims and survivors. Preface Confronted with a wide variety of conflicts, the international community has attempted to respond through humanitarian assistance, development aid, crisis prevention and conflict resolution programmes. To date many of these activities have exacerbated conflict dynamics as much as they have enhanced the opportunities for sustainable development and peace. In an effort to understand what works, lessons learned and best practices are being collected usually in the form of evaluations of individual projects or programs. Although the number of studies undertaken has increased, few lessons have been systematised or accumulated for broader discussion in the academic field or for practitioners' use. The Berghof Research Center for Constructive Conflict Management produced this Handbook in response to the contemporary challenges which have to be faced by those who are working in and on violent conflict. The intention is to give an overview of recent developments in the field of conflict transformation from various perspectives: from academic analysts and practitioners as well as from experts representing different areas of work inside and outside of conflict zones.
