Unlike in other countries of Eastern Europe where the opposition to communism came in the form of single mass movements led by charismatic leaders such as Václav Havel and Lech Wałęsa, in Hungary the opposition was very fragmented, brought together and made effective only by the authoritative, significant but relatively unknown Árpád Göncz, who subsequently became Hungary’s first post-communist president. This book charts the political career of Árpád Göncz, outlining the outstanding contribution he made to Hungary’s transition to democracy. Drawing on a wide range of sources, including archives and interviews with Göncz himself and others, it shows how Göncz, unlike Havel who was a playwright and whose political role was largely symbolic, was a campaigning politician all his life, consistently advocating social democratic, but not communist, values. Imprisoned from 1956 for his participation in the 1956 uprising, Göncz was a highly-effective political operator in the transition period around 1989, and as president wielded real power effectively. As politics in Hungary are again marred by deep division and fragmentation, Göncz’s success in bringing rival groups together is even more pronounced.

This book,one of the very first monographs on the Hungarian Constitutional Court available in English, is a unique study of the birth of a new legal system after the collapse of communism in Central and Eastern Europe. It shows that the genesis of the new legal order was determined by massive Western involvement and an unprecedented movement of export/import of law. Anchored in a detailed comparative study of German and Hungarian constitutional case law on human dignity, this book argues that law importation was a deliberate strategy carried out by the Hungarian Court in the early years of its operation. It explains how the circumstances of the transition and the background of the importers determined the choice of German case law as a model and how the Court used it to construct its own version of the right to human dignity. It highlights the Hungarian Court's instrumentalisation of imported law in order to lay the foundations of a new conception of fundamental rights. While focusing on the Hungarian experience, this book engages with international debates and provides an original theoretical framework for approaching the movement of law from the importers' perspective.

This book examines the crisis of democracy that has arisen in Hungary since the election of the Fidesz government in 2010. After moving swiftly to transform the Hungarian constitution, Fidesz created a new political system which has led its critics to argue that the era of democracy in Hungary is over. US Senator John McCain has gone so far as to describe Hungary as an illiberal democracy on a path toward fascism. The author argues that Fidesz has sought to challenge the capitalist and democratic transformation that shaped Hungary for 20 years after the fall of communism by increasing the power of the state over crucial aspects of the economy, society, and the political system. In so doing Fidesz’ actions resemble those undertaken by many authoritarian states that have emerged since the end of the Second World War, all aiming to build up a national capitalism and protect their economies whilst undertaking nation-building. To make sense of this the author draws upon two traditions of thought, world systems-analysis, which situates Hungary in the context of its incorporation in the modern capitalist world-system after the fall of communism; and anarchist social thought which provides a unique way of seeing the actions of states and political elites. In so doing the book argues that the events unfolding in Hungary cannot be explained on the basis of Hungarian exceptionalism but must be situated in the broader political and economic context that has shaped the development of Hungary since 1990. The form of capitalism introduced in Hungary and across the region of East and Central Europe has systematically undermined the strong state and social security that had existed under communism, and when added to the failure of the left and liberals in the region it has paved the way for far-right and neo-fascist political movements to emerge claiming the mantle of defenders of society from the market. This represents a fundamental threat to the enlightenment traditions that have shaped dominant modern political ideologies and raises profound problems for both the EU and NATO.
