When American settlers arrived in the southwestern borderlands, they assumed that the land was unencumbered by property claims. But, as María Montoya shows, the Southwest was no empty quarter simply waiting to be parceled up. Although Anglo farmers claimed absolute rights under the Homestead Act, their claims were contested by Native Americans who had lived on the land for generations, Mexican magnates like Lucien Maxwell who controlled vast parcels under grants from Mexican governors, and foreign companies who thought they had purchased open land. The result was that the Southwest inevitably became a battleground between land regimes with radically different cultural concepts. The struggle over the Maxwell Land Grant, a 1.7-million-acre tract straddling New Mexico and Colorado, demonstrates how contending parties reinterpreted the meaning of property to uphold their claims to the land. Montoya reveals how those claims, with their deep historical and racial roots, have been addressed to the satisfaction of some and the bitter frustration of others. Translating Property describes how European and American investors effectively mistranslated prior property regimes into new rules that worked to their own advantage--and against those who had lived on the land previously. Montoya explores the legal, political, and cultural battles that swept across the Southwest as this land was drawn into world market systems. She shows that these legal issues still have real meaning for thousands of Mexican Americans who continue to fight for land granted to their families before the Treaty of Guadalupe Hidalgo, or for continuing communal access to land now claimed by others. This new edition of Montoya’s book brings the land grant controversy up to date. A year after its original publication, the Colorado Supreme Court tried once more to translate Mexican property ideals into the U.S. system of legal rights; and in 2004 the Government Accounting Office issued the federal government’s most comprehensive effort to sort out the tangled history of land rights, concluding that Congress was under no obligation to compensate heirs of land grants. Montoya recaps these recent developments, further expanding our understanding of the battles over property rights and the persistence of inequality in the Southwest.

The purpose of this study is to provide an overview of some of the main intellectual property right issues relevant to the domain of translation. It focuses on copyright and database rights at international, European, and national levels. National legal regimes in four European Member States (i.e., Belgium, France, Germany and the United Kingdom) have been compared for illustration purposes. The study takes an "upstream" and "downstream" approach in order to answer the following three questions: (i) Are source documents protected by copyright and how does that protection affect the right to translate them? (Upstream or "input" approach, i.e., focus on the rights on the pre-existing source documents). (ii) Are translations protected by copyright and, if so, how? (Downstream or "output" approach, i.e., focus on the rights on the work product). (iii) Are databases that segment and align source documents and translations protected and, if so, how? (Link between the input and the output). The study covers both traditional translations and machine-aided translations. The main principles and findings developed in the Study are summarised below.

Filastin, veröffentlicht ab 1911 in Jaffa von Isa al-Isa und Yusuf al-Isa, lokalen griechisch-orthodoxen Christen, diente als Medium, in dem ein vielfältiges Spektrum an palästinensischen Autoren verschiedener Konfession folgende Fragen kontrovers verhandelte: 1. Regeln des Zusammenlebens im multiethnisch und multikulturell geprägten Jaffa; 2. Die Integrierbarkeit der jüdisch-zionistischen Einwanderer in die Region, und 3. die Partizipation arabisch-palästinensischer Christen im von Griechen dominierten griechisch-orthodoxen Patriarchat von Jerusalem. Exploring Filas?in in the context of Arab Palestinian press development, its specific environment and networks, and the political culture after the Young Turk Revolution, this study analyzes the main concepts and terminological features that are conveyed through ist coverage. Further, it studies Palestinian group relations in the light of three selected case studies: the press debate on 1. the social cohabitation of groups in the Jaffa region, 2. the socio-economic integration of Zionist immigrants into the Jerusalem District, and 3. the political participation of Arab Palestinian Orthodox Christians in the administration of the Greek Orthodox Patriarchate of Jerusalem, and their opposition against the clerical establishment. Filastin was published from 1911 onwards in the coastal town of Jaffa by the cousins Yusuf and Isa al-Isa, Arab Palestinians of Greek Orthodox confession. Soon, it had established itself as a 'forum of debate' in late Ottoman Palestine, serving a pool of authors from different ethnic and confessional but similar educational backgrounds and moral values as a public medium to which they contributed through publishing articles, protest letters, petitions, etc. On its pages, these authors controversially discussed concepts of collective identity, society-building, political order and all kinds of reforms that they perceived progressive and as fitting the 'spirit of the age', as they called it: the age of Ottoman Constitutionalism and modernity. This study explores local debates on Palestinian group relations through Filastin during the years 1911 until 1914 which is relevant since, during this period of time, the Arab Middle East in general and Palestine in specific underwent a so-called 'saddle period'; a deep and fundamental change with regard to social relations and political concepts that is still rather unexplored in today's scholarship.

Arising from recent developments at the international level, many developing countries, indigenous peoples and local communities are considering using geographical indications (GIs) to protect traditional knowledge, and to promote trade and overall economic development. Despite the considerable enthusiasm over GIs in diverse quarters, there is an appreciable lack of research on how far and in what context GIs can be used as a protection model for traditional knowledge-based resources. This book critically examines the potential uses of geographical indications as models for protecting traditional knowledge-based products and resources in national and international intellectual property legal frameworks. By analysing the reception towards GIs from developing countries and advocates of development in the various legal and non-legal regimes (including the World Trade Organization, World Intellectual Property Organization, and the Convention on Biological Diversity and the Food and Agricultural Organization), the book evaluates the development potential of GIs in relation to ensuing changes in international intellectual property law in accommodating traditional knowledge. Teshager W. Dagne argues for a degree of balance in the approach to the implementation of global intellectual property rights in a manner that gives developing countries an opportunity to protect traditional knowledge-based products.
