"Intento hacer evidentes, mediante ejemplos por doquier, las reglas abstractas de la ley; aporto; incluso en aquellas debatidas cuestiones, de todos conocidas y muy tratadas, solo penetro a modo de alusión. Únicamente por este camino creo acercarme al fin que me he propuesto: ofrecer una exposición llena de vida, clara y, sin embargo, concisa, del Derecho mercantil, que sirva de primera introducción seria en estos dominios. El Derecho mercantil es un conjunto extraordinariamente fragmentario; solo interviene en el tráfico mercantil o de los comerciantes cuando las particulares exigencias de este exigen una regulación especial. Para cubrir sus lagunas se acude generalmente a las reglas del Derecho civil común. Sin embargo, de cuando en cuando, se toman también en consideración preceptos que ocupan una posición intermedia entre el Derecho especial del comercio y el Derecho civil común, en tanto hayan sido estructurados, por ejemplo, sobre las especiales exigencias de la explotación de todos los negocios de adquisición—pudiendo ser aquélla mercantil o no—. Preceptos de este género pueden colocarse al lado del Derecho mercantil como Derecho industrial común". Konrad Cosack.
