O presente estudo pretende examinar, primeiramente, a posição de Immanuel Kant quanto ao problema da liberdade da vontade enquanto pressuposto transcendental (ôntico-antropológico) da responsabilização jurídico-penal ou imputabilidade. Prosseguindo, busca analisar a crítica de Arthur Schopenhauer ao modo como Kant postula, quando de sua filosofia prática, a liberdade da vontade como a condição de possibilidade da imputabilidade. Muito basicamente, segundo Schopenhauer, uma liberdade prática relativa, traduzida numa vontade intelectualmente determinável, e não uma liberdade prática absoluta, traduzida em livre-arbítrio (conquanto escamoteado por Kant sob a denominação de "autonomia transcendental" e quejandos), é que seria o verdadeiro elemento viabilizador da imputação estatal, donde sua conclusão no sentido de ser a modificabilidade (o potencial de modificação do agente), e não a culpabilidade convencional (retributivismo punitivista), o principal fator com que a sociedade e o Estado deveriam se preocupar. Isso significa dizer, por fim, que, no entender de Schopenhauer, uma concepção alternativa crítico-determinista como a sua, ao contrário do que afoitamente se diz, não compromete a imputabilidade, antes, explica-a enfim, sem subterfúgios ou apelos metafísicos.
