This report finds the clinical treatment and rehabilitation of service personnel seriously injured on military operations to be highly effective, but notes that the rate of illness and minor injury among personnel on operations has almost doubled in three years. 522 military personnel were seriously injured on operations in Iraq and Afghanistan between October 2001 and October 2009. Personnel on operations have attended medical facilities 125,000 times for minor injury and illness since 2006 and a further 1,700 times for mental health conditions. The NAO has estimated that the cost of medical care provided as a result of military operations was £71 million in 2008-09. Military commanders, and the patients to whom the NAO spoke, have confidence in the clinical treatment provided at medical facilities in Afghanistan, at Selly Oak, the main hospital for seriously injured troops, and at Headley Court, the MOD's main rehabilitation facility. Medical capacity at both Selly Oak and Headley Court has been sufficient to deal with casualties to date, but it is under increasing pressure. The main field hospital in Afghanistan - Camp Bastion - is currently coping with casualty levels, but working close to capacity. Contingency plans for providing further capacity back in the UK for care for injured Service personnel have recently improved, but should be developed further.

Since October 2001 565 service men and women have been seriously injured in Iraq and Afghanistan, some 125,000 troops based there have sought medical help for minor injuries and illnesses, and a further 1,700 for mental health conditions. Nearly all seriously injured troops who return back to the UK for medical treatment go first to the NHS hospital at Selly Oak and then to Headley Court for rehabilitation. The care of the seriously injured to date has been highly effective, and support for the families of seriously injured troops is good. The main challenge the Department faces, should casualties increase significantly, is to ensure that all military patients will receive the same standard of care they currently experience at Selly Oak and Headley Court. Some soldiers have suffered severe life changing injuries and will require specialist care for many years. This presents a further long term challenge not only for the Department who provide specialist care for them and support for their families while they remain in the Services, but also for the NHS and other government departments who will become responsible for the medical care and support of seriously injured soldiers after they leave the Armed Forces. Minor injury and illness are a lesser issue but still have the potential to impact on the fighting strength and morale of our Armed Forces in Afghanistan and the increase in rates from 4 to 7 per cent since 2006 is of concern.

The Government must show how the excellent medical care being delivered to injured service personnel will continue long after the memory of the Afghan Operation fades. This report, which gives praise to the first class medical treatment provided for the Armed Forces, questions whether the support for injured personnel will be sustainable over the long term. In particular, the committee is concerned about the number of people who may go on to develop severe and life-limiting, physical, mental health, alcohol or neurological problems. There is still a question mark over whether the Government as a whole fully understands the likely future demands and related costs

For the sixth successive year, the Ministry of Defence Accounts were qualified. The Qualifications covered non-compliance with international reporting standards on the treatment of some contracts; lack of audit evidence on the valuation of inventory (worth some £3 billion) and of capital spares (worth some £7 billion); and on the regularity of the Accounts because of the failure to obtain approval for the remuneration package of the Chief of Defence Materiel. The MoD was also five months late in submitting its audited accounts to Parliament. The National Audit Office had found errors in its sample examination of accruals and so the MoD decided to resolve these problems before submitting the accounts. The MoD said they did not have the necessary expertise to manage the financial complexity that featured in the implementation of the Strategic Defence and Security Review so sought assistance. The MoD should ensure its people have the right skills to deal with all financial problems so that they do not need to bring in expensive external accountants. There is also concern about the MoD's reluctance to estimate the full costs of its operations in Afghanistan, Iraq and Libya. The NAO did not consider that the MoD has adequate information, especially with respect to recording the cost of its activities and outputs, to run its business effectively. The MoD should set out its commitment to improving its management information. It is also vital that defence spending remains at more than 2 per cent of GDP in line with the UK's NATO commitment.

This book studies the evolution of the war prerogative in England from 1600-2012. It traces the historical theory and practice of the war prerogative and proposes reform of the constitutional arrangements for its exercise. It addresses three key questions. First, what have writers on political and constitutional theory said about the constitutional arrangements for the war prerogative, and, in particular, what justifications have been advanced for those arrangements? Secondly, in practice, has the executive in fact possessed sole and exclusive powers over war and the deployment of force, or have Parliament and the courts had a role to play in their exercise and scrutiny? Thirdly, are there better ways to organise our constitutional arrangements for the war prerogative, to enable a more substantive role for Parliament (particularly the House of Commons) in its exercise and scrutiny? On the first question, it is shown that orthodox theoretical and political discourses have continuously asserted the executive's exclusive power over war, but the justifications advanced for that arrangement have changed over time. Those changes reflect the varying influence of different political theories at different times. On the second question, it is found that, contrary to orthodox theoretical and political discourses, Parliament has played an active and substantive role in the exercise and scrutiny of the war prerogative. The courts have refused to intervene in the exercise of the war prerogative, but have been more ready to intervene in cases involving the exercise of powers incidental to the war prerogative. On the third question, it is argued that reform of the constitutional arrangements for the war prerogative is necessary and desirable. The use of 'institutional mechanisms' is recommended, which are small-scale rules and institutional arrangements, within existing institutions, which aim to promote certain normative goals. In particular, the enactment of a statute is proposed, which would impose conditions on the executive's exercise of its war prerogative. It is argued that these proposals show that, through careful institutional design, democratic values, national security, and operational efficiency can each be reconciled and promoted.
