Digital technologies are being adopted at a faster pace than previous waves of innovation, and their use is re-shaping administration and business, consumer behaviour and social interactions. They are subject to widely varying regimes, from lightly regulated but heavily standardised global equipment markets, heavily regulated markets for wireless services, to barely regulated over the top (OTT) services. The regulation of aggregators and platforms is achieving greater attention. Leading governments encourage the creation of new technologies and the adoption of existing and emerging technologies, in pursuit of economic growth and improved productivity. They fund research and development (R&D), expansion of university courses, the creation and growth of technology hubs, the deployment of new networks (e.g., FTTH and 5G) and the extension of established networks in areas considered not commercially viable. Considerable attention has been given to the Internet of Things (IoT) and the Industrial Internet of Things (IIoT), frameworks for connecting billions of objects, enabling smart buildings, homes, factories and cities. To secure economic and social gains, governments are updating cybersecurity strategies, to counter threats from criminals, hostile states and terrorists. The European Union (EU) has elevated data protection to be a right, alongside privacy, and enacted the General Data Protection Regulation (GDPR), supported by a network of national supervisory authorities. Skills shortages are long-standing, despite some international movement of individuals, with growing demand in cybersecurity, and with growing demand for the skills required to work with artificial intelligence and robotics. There remain difficulties in measuring the digital economy and society.

This book illustrates the challenges that regulators and policy makers have faced in the transition from the ‘old’ network industries to the new digital ecosystem. Harnessing the economic opportunities of digital technologies often requires changes in policy and regulation. Domestic regulation and policy-making alone are unable to deal with the multilevel interactions that take place in the governance of digital technologies. In an era of unprecedented levels of interdependence, measures that regulate the global digital economy at the regional and at the international levels are fundamentally important. Despite the growing need for international cooperation in technology policy-making, global governance is falling short of their tasks. In particular, multilateral institutions and formal mechanisms of coordination are not representative of the interests and policy priorities of low- and middle-income countries. Drawing on the findings of a recent study, this essay seeks to understand the relative importance of international coordination in technology policy in developing countries. In doing so, it addresses how low- and middle-income countries can design and adopt much-needed digital regulation while rethinking the international dynamics that shape domestic and cross-border technology policy-making.

The digital economy has been growing by leaps and bounds in recent years, mostly as a result of new digital technologies that are promoting a global transformation to industry 4.0. The resulting expansion of digital trade has sparked off a political and policy controversy on digital economy and e-commerce, where its boundaries stand and how best to regulate it. Policy discussions on the topic however do not take into account the true expanse of digital trade, which encompasses hardware, software, networks, platforms, applications and data as its core elements, and stretches the boundaries of e-commerce policy to trade in goods, services and intellectual property protection. This Article focuses on the challenges in regulating the digital economy, with a particular focus on development, and offers a discussion of the interdependency between the economic, social, personal and developmental aspects of digital trade for developing countries. Section II opens with a detailed discussion on key digital technologies and their plausible impacts on employment globally and industrial catch-up of particular importance to developing countries, to highlight the divisive nature of digital technologies. Section III then analyses the unfulfilled promise of a pro-development perspective at the WTO looking at how multilateralism has currently failed e-commerce. The incoherence between digital realities and the policy debates at the WTO are presented to show how the institution is losing effectiveness in the war between countries to legitimize national policies on a universal level in this important area of policy making. Norm-setting through FTAs is also analysed at length in section III of the article, which provides a comprehensive review of the plurilateral and bilateral policy developments in e-commerce. The ramifications for developing countries are discussed in the form of a couple of examples. Section IV presents some options for developing countries for the future at the national and international level.

The world is experiencing unprecedented increases in connectivity and global data flows. This is underpinning the so-called fourth industrial revolution. Cross-border data access, usage and exchange is essential to economic growth in the digital age. Every industry - including manufacturing, services, agriculture, and retail - relies on data and on the global flow of that data. A number of studies have been published that highlight the scale and importance of cross-border data flows. While the economic and trade opportunity from connectivity and data flows are significant, governments are increasingly introducing measures which restrict data flows - data localization measures. Such measures will have economic and trade costs.Governments restrict cross-border data flows in order to achieve a number of objectives. The main goals of data localization are as follows: 1. Protecting or improving citizen personal privacy. 2. To ensure rapid access to data by law enforcement officials. 3. Protecting or ensuring national security.4. Improving economic growth or economic competitiveness.5. In order to level the regulatory playing field. The key focus for all government when designing regulation to achieve legitimate goals should be to manage risk - whether to privacy, from cyber-attack or the impact of delays to law enforcement agencies - to an acceptable level relative to the economic and social benefits, including innovation, expected from these activities. While it is up to each government to determine its acceptable level of risk, in most cases, data localization is sub-optimal in that there are ways to achieve legitimate regulatory goals with less impact on economic growth and trade.
