Academic Paper from the year 2012 in the subject Law - Criminal process, Criminology, Law Enforcement, grade: 2.1, City University London (The City Law School), course: LLM Criminal Litigation, language: English, abstract: The use of the internet has increased over the recent decade. It is to be expected that many people who are summoned for jury service will have some type of experience in its usage and may attempt to make reference to it. This leads to jury members searching for information about their case online. Public confidence in the jury system is waning whilst miscarriages of justice, as a result of misuse of the internet by jurors, is increasing. Recent case law has identified a variety of different types of jury impropriety and has confirmed the limitations imposed by the protection of the confidentiality of jury deliberations. How can the misuse be stopped? What can be defined as a misuse of the internet? Do only conscious findings count or even findings by chance? How do one deal with "stumbling" over information? James Michael Corbett gives an analysis into the problem of internet misuse committed by jurors in a court of law. From a practical point of view, he considers how serious the problem of misuse of the internet by jurors is and discusses the arguments for and/or against different approaches to overcoming the problem. Abolishing the misuse is the only way to prevent victims of having to be put through the whole process a second time because the jury may be discharged along with a new jury being empanelled.

As computer-related crime becomes more important globally, both scholarly and journalistic accounts tend to focus on the ways in which the crime has been committed and how it could have been prevented. Very little has been written about what follows: the capture, possible extradition, prosecution, sentencing and incarceration of the cyber criminal. Originally published in 2004, this book provides an international study of the manner in which cyber criminals are dealt with by the judicial process. It is a sequel to the groundbreaking Electronic Theft: Unlawful Acquisition in Cyberspace by Grabosky, Smith and Dempsey (Cambridge University Press, 2001). Some of the most prominent cases from around the world are presented in an attempt to discern trends in the handling of cases, and common factors and problems that emerge during the processes of prosecution, trial and sentencing.

The relative anonymity the Internet provides allows us to assert our knowledge like a professor, show off our seemingly perfect lives, and judge like we’re presiding over a court of law. The problem with this relatively new phenomenon is that we often make snap judgments about other people’s actions or statements without knowing all of the facts, and without giving others the benefit of the doubt. This volume dives deep into the realities of the Internet age: Do we become different people when we’re on the Internet? What responsibility do we have in our treatment of others in this new society? Is it our place to be virtual judge and jury?

The Internet brings opportunity and peril for media freedom and freedom of expression. It enables new forms of publication and extends the reach of traditional publishers, but its power increases the potential damage of harmful speech and invites state regulation and censorship as well as manipulation by private and commercial interests. In jurisdictions around the world, courts, lawmakers and regulators grapple with these contradictions and challenges in different ways with different goals in mind. The media law reforms they are adopting or considering contain crucial lessons for those forming their own responses or who seek to understand how technology is driving such rapid change in how information and opinion are distributed or restricted. In this book, many of the world's leading authorities examine the emerging landscape of reform in nations with variable political and legal contexts. They analyse developments particularly through the prisms of defamation and media regulation, but also explore the impact of technology on privacy law and national security. Whether as jurists, lawmakers, legal practitioners or scholars, they are at the front lines of a story of epic change in how and why the Internet is changing the nature and raising the stakes of 21st century communication and expression.

Clinical Psychology written by Stefan G. Hofmann and has been published by John Wiley & Sons this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-10-23 with Psychology categories.

The first book to offer a truly global perspective on the theory and practice of clinical psychology While clinical psychology is practiced the world over, up to now there has been no text devoted to examining it within a global context. The first book of its kind, Clinical Psychology: A Global Perspective brings together contributions from clinicians and scholars around the world to share their insights and observations on the theory and practice of clinical psychology. Due partly to language barriers and entrenched cultural biases, there is little cultural cross-pollination within the field of clinical psychology. In fact, most of the popular texts were written for English-speaking European and Anglo-American audiences and translated for other countries. As a result, most psychologists are unaware of how their profession is conceptualized and practiced in different regions, or how their own practices can be enriched by knowledge of the theories and modalities predominant among colleagues in other parts of the world. This book represents an important first step toward rectifying that state of affairs. Explores key differences and similarities in how clinical psychology is conceptualized and practiced with children, adolescents and adults across different countries and cultures Addresses essential research methods, clinical interviews, psychometric testing, neuropsychological assessments, and dominant treatment modalities Follows a consistent format with each chapter focusing on a specific area of the practice of clinical psychology while integrating cultural issues within the discussion Includes coverage of how to adapt one’s practice to the differing cultures of individual clients, and how to work in multidisciplinary teams within a global context Clinical Psychology: A Global Perspective is a valuable resource for students, trainees, and practicing psychologists, especially those who work with ethnic minority groups or with interpreters. It is also a must-read for practitioners who are considering working internationally.

The debate over the use of copyright law to prevent competition and interoperability in the global software industry. We live in an interoperable world. Computer hardware and software products from different manufacturers can exchange data within local networks and around the world using the Internet. The competition enabled by this compatibility between devices has led to fast-paced innovation and prices low enough to allow ordinary users to command extraordinary computing capacity. In Interfaces on Trial 2.0, Jonathan Band and Masanobu Katoh investigate an often overlooked factor in the development of today's interoperabilty: the evolution of copyright law. Because software is copyrightable, copyright law determines the rules for competition in the information technology industry. This book—a follow-up to Band and Katoh's successful 1995 book Interfaces on Trial—examines the debates surrounding the use of copyright law to prevent competition and interoperability in the global software industry in the last fifteen years. Band and Katoh are longtime advocates for interoperable devices but present a reasoned view of contentious issues related to interoperability issues in the United States, the European Union, and the Pacific Rim. They discuss such topics as the protectability of interface specifications, the permissibility of reverse engineering (and legislative and executive endorsement of pro-interoperability case law), the interoperability exception to the U.S. Digital Millennium Copyright Act and the interoperability cases decided under it, the enforceability of contractural restrictions on reverse engineering; and recent legal developments affecting the future of interoperability, including those related to open source-software and software patents.
