This book addresses the effectiveness of transitional justice mechanisms for repairing social cohesion. Truth commissions and reparation programs are implemented worldwide to enhance social cohesion, peace and democracy in post-conflict settings. Most claims about transitional justice measures are, however, normatively and not empirically based. The book questions whether attention from a truth and reconciliation commission can truly change the lives of the violence-affected people and whether monetary compensations or communal projects in form of milk cows can ever truly "repair" the harm suffered. The within-country comparative case study analyzes the effects of the commission and reparation program in Peru. It studies the post-conflict situation and the development of social cohesion in communities affected by the internal armed conflict. Using detailed empirical data this analysis reveals why the "reparation" of social cohesion in Peru was an impossible task. Contributing to a broader understanding of the impact of nationally applied transitional justice instruments in local settings, the book further offers a new framework for analyzing social cohesion as one of the aims of transitional justice processes. Offering a detailed account of transitional justice processes and social cohesion on the micro level, as well as an important analysis of their relationship, this innovative monograph will be invaluable for transitional justice scholars and students, as well as for international political and societal actors who are involved in transitional justice measures.

The South African Truth Commission written by Dorothy C. Shea and has been published by US Institute of Peace Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2000 with South Africa categories.

In the latter half of the 1990s, South Africa's Truth and Reconciliation Commission (TRC) offered the country the chance to build a better future by facing up to its past. Amid saturation media coverage, victims of human rights abuses told their harrowing stories and perpetrators confessed to horrendous acts. Meanwhile, the commissioners grappled with decisions that would not only apportion responsibility and grant or deny amnesty but also have a profound political and social impact. To this highly charged, controversial subject, Dorothy Shea brings a rare combination of objectivity, thoroughness, and a firm grasp of both the principles and the political interests at stake. She begins by investigating the origins of the TRC in South Africa's transition from apartheid to democracy, and she examines the extent to which it learned from the experiences of earlier, Latin American commissions. Then she focuses on how the politics of the TRC were played out in issues such as amnesty, reparations, and prosecutions. Her report on the TRC offers a generally positive assessment and explains not only how South Africa measured up but also why. Finally, Shea draws lessons from the TRC experience that may help to inform future efforts to shape and establish truth commissions in other transitional societies.

Spectres Of Reparation In South Africa written by Jaco Barnard and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 2023 with Reparation (Criminal justice) categories.

"This book argues that South Africa is haunted by the spectre of reparation. The failure of the South African Truth and Reconciliation Commission to secure adequate reparation for the victims of colonisation and apartheid continues to drastically undermine the commission's processes and legacy. Investigating the TRC's key processes of amnesty, archiving and forgiveness in turn, the book demonstrates that each process is fundamentally thwarted by the terminal lack of reparation. These multiple forms of the spectre of reparation haunt post-apartheid society in deeply traumatogenic ways. The book proposes a new ethic of "reparative citizenship" as a means of encountering the spectres of reparation in a productive and transformative manner, generating hope even in the face of the irreparable. This book will be an important read for South Africans interested in overcoming the impasses and injustices that haunt the country, but it will also be of interest to post-conflict transitional justice and politics researchers more broadly"--

Reparations And War written by Luke Moffett and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2023-01-13 with Political Science categories.

War devastates the lives of those who are caught up in it. For thousands of years, reparations have been used to secure the end of war and alleviate its deleterious consequences. More recently, human rights law has established that victims have a right to reparations. Yet, in the face of conflicts that last for decades with millions of victims, how feasible are reparations? And what are the obstacles to delivering them? Using interviews with hundreds of victims, ex-combatants, government officials, and civil society actors from six post-conflict countries, Reparations and War examines the history, theoretical justifications, and practical challenges of implementing reparations after war. It examines the role of non-state armed groups in making reparations, the role of victim mobilisation, the evolving use of reparations, and the political instrumentalization of redress. Luke Moffett offers a measured and honest account of what reparations can and cannot do. This book sheds new light on how reparations can be politically manipulated, or used to reward those loyal to the State, rather than to achieve justice for the victims who suffer.

There is an emerging consensus that what is projected as democratic governance and justice in Africa requires a re-calibration, in particular, in relation to the constitutive demos, human rights, the realisation of commitments at various governance levels and the convergence between these ideations. The post-colonial narrative on democracy has unveiled some crevices in rule of law, political equality, political participation, political culture and freedom of the press. Aside from the fact that these notions are threatened by some existing institutional structures, these notions are increasingly being negotiated across political spaces. Evident in the prevalent narrative is an imperative for Africa to assert its place on the global scene of democratic governance and justice. However, if this will be accomplished, it is important to understand some of the issues that need to be worked through in this transition.
