Esta obra colectiva realiza un balance de los últimos años de trabajo y del esfuerzo de todos los operadores jurídicos por disminuir las cifras de víctimas de la violencia de género, para dotarles de un mayor y mejor nivel de protección en todos los ámbitos.La tutela jurisdiccional, aunque abarque todos sus órdenes y vertientes funcionales, no es la panacea que va a venir a resolver -ni mucho menos a prevenir- todas las tragedias que padecen y que acechan a las víctimas de la violencia de género. Como se ha repetido una y otra vez desde los ámbitos de conocimiento más diversos, si la sociedad actual no alcanza mayores cotas de educación -en el respeto a la igualdad y en la formación de la mujer- y si no es capaz de ofrecer un sistema de asistencia social efectiva a aquellas que necesitan poner fin a su situación personal de dominación y maltrato físico y/o psicológico, no disminuirán las cifras delictivas -las que constan y las que no-y las víctimas, potenciales y reales, no podrán estar en condiciones de hacer frente a las situaciones que las amenazan y atenazan.Ahora bien, es mucho lo que se puede hacer y se está haciendo desde todos los campos del Derecho para ofrecer a la víctima de la violencia de género la tutela normativa y jurisdiccional que puede requerir. En este volumen hemos procurado recopilar aquellos aspectos que, desde diversas vertientes jurídicas -constitucional, penal, civil, procesal, laboral, cooperación judicial y Unión Europea- nos resultaban más necesarios y relevantes en este momento.

Though at first glance, it might seem as if the answer to the question Can we live together? is that we already do live togetherwatching the same television programs, buying the same clothes, and even using the same language to communicate from one country to anotherthe author argues that in important ways, we are farther than ever from belonging to the same society or the same culture. Our small societies are not gradually merging into one vast global society; instead, the simultaneously political, territorial, and cultural entities that we once called societies or countries are breaking up before our eyes in the wake of ethnic, political, and religious conflict. The result is that we live together only to the extent that we make the same gestures and use the same objectswe do not communicate with one another in a meaningful way or govern ourselves together. What power can now reconcile a transnational economy with the disturbing reality of introverted communities? The author argues against the idea that all we can do is agree on some social rules of mutual tolerance and respect for personal freedom, and forgo the attempt to forge deeper bonds. He argues instead that we can use a focus on the personal life-projectthe construction of an active self or subjectultimately to form meaningful social and political institutions. Women’s rights advocates in the United States have long argued that violence against women denies women equality and citizenship, but it took a movement of feminist activists and lawyers, beginning in the late 1960s, to set about realizing this vision and transforming domestic violence from a private problem into a public harm. This important book examines the pathbreaking legal process that has brought the pervasiveness and severity of domestic violence to public attention and has led the United States Congress, the Supreme Court, and the United Nations to address the problem. Elizabeth Schneider has played a pioneering role in this process. From an insider’s perspective she explores how claims of rights for battered women have emerged from feminist activism, and she assesses the possibilities and limitations of feminist legal advocacy to improve battered women’s lives and transform law and culture. The book chronicles the struggle to incorporate feminist arguments into law, particularly in cases of battered women who kill their assailants and battered women who are mothers. With a broad perspective on feminist lawmaking as a vehicle of social change, Schneider examines subjects as wide-ranging as criminal prosecution of batterers, the civil rights remedy of the Violence Against Women Act of 1994, the O. J. Simpson trials, and a class on battered women and the law that she taught at Harvard Law School.
