Negare il diritto alla salute significa trasformare il cittadino in un cliente e considerare la salute come una merce. La Costituzione specifica che la Repubblica «tutela la salute». È una delle più alte affermazioni presenti, e la salute è l’unico diritto definito come «fondamentale». Oggi il diritto alla salute è minacciato dal definanziamento del Servizio sanitario nazionale, dalla privatizzazione strisciante, dal mancato riconoscimento di alcuni fondamentali diritti bioetici. I diritti di salute sono minacciati non soltanto dalle politiche nazionali e regionali ma anche da comportamenti e vicende che partono “dal basso” e si ripropongono ciclicamente nel nostro Paese con schemi ormai consolidati. È la salute “a furor di popolo”, che vanta una non proprio lusinghiera tradizione. I diritti di salute sono minacciati anche dalla violenza istituzionale, perpetrata, in alcuni contesti, da strutture sanitarie e forze dell’ordine, a cui sono affidati cittadini che dovrebbero avere diritto a essere protetti. Nel libro particolare attenzione è stata posta anche alla medicina difensiva, che rappresenta un effetto distorsivo del modo di agire dei professionisti sanitari al solo fine di prevenire contenziosi giudiziari nei loro confronti. Luca Benci, giurista, è esperto di diritto sanitario e di biodiritto. Nella sua attività di saggista ha pubblicato libri sulla responsabilità professionale sanitaria e sulle professioni sanitarie. Recentemente ha scritto la monografia In otto punti le ragioni del NO al referendum costituzionale.
