HMRC estimates that in 2010-11 the tax gap due to avoidance was £5 billion and that the present total tax at risk from avoidance over time is £10.2 billion. There is a proliferation of contrived schemes which exploit loopholes in legislation and abuse available tax relief schemes. Promoters are deliberately taking advantage of the time lag between the launch of a scheme and the closure of the scheme by HMRC. Promoters and providers sign up as many clients as possible before HMRC changes the law and shuts the scheme. They then move on to a new scheme and repeat the process. The complexity of tax law creates opportunities for avoidance, there is no effective deterrent, and HMRC is ineffective in challenging promoters. All too often Government introduces tax incentives to stimulate economic activity that become an opportunity for tax avoidance. Promoters collect their fees even when the schemes are found not to deliver a tax advantage and few schemes are covered by mis-selling regulations. Those who promote a tax avoidance scheme are required to notify HMRC of the scheme however, HMRC does not know how much avoidance is not disclosed but should. It is alarming that some QCs' opinions are being used by promoters as a "reasonable excuse" for non-disclosure which prevents HMRC from applying a penalty. HMRC could learn from how other countries deter and tackle tax avoidance. HMRC should also name and shame those who promote tax avoidance schemes, to harness public opinion and reduce the appetite of companies to promote or use avoidance schemes.

Academies are funded directly by central government, directly accountable to the Department for Education, and outside local authority control. They have greater financial freedoms than maintained schools. By September 2012 the number of open academies had increased tenfold, from 203 to 2,309. Academies are the Department's chosen vehicle for school reform, but increasing schools' autonomy and removing them from local authority control gives the Department responsibility for ensuring value for money. The Department has incurred significant costs from the complex and inefficient system it has used for funding the Academies Programme and its oversight of academies has had to play catch-up with the rapid growth in academy numbers. In the two years from April 2010 to March 2012, the Department spent £8.3 billion on Academies; £1 billion of this was an additional cost to the Department not originally budgeted for this purpose, some of which was not recovered from local authorities. The Department must improve the efficiency of its funding mechanisms and stop the growth in other costs. Furthermore, the Department has yet to establish effective school-level financial accountability for academies operating within chains. What will determine whether the Department ultimately achieves value for money is academies' impact on educational performance relative to the investment from the taxpayer. If the Department is to be held properly to account for its spending on academies, it must insist that every Academy Trust provides it with data showing school-level expenditure, including per-pupil costs, and with a level of detail comparable to that available for maintained schools.

Infrastructure UK, an advisory unit within the Treasury, was established in 2010 with a remit to specify what economic infrastructure is needed in the UK, to identify the key barriers to achieving that investment and to mobilise systems and resources, both public and private to make it happen. The first National Infrastructure Plan was published in 2010. The latest update of the plan, published in December 2012, comprised over 500 prospective programmes and projects for new economic infrastructure expected to cost £310 billion. Some 64% of this amount is expected to be spent on infrastructure that will be wholly owned and financed by the private sector with households bearing the costs through higher bills or fares. Many of the investment proposals impact on energy supply and are therefore particularly time critical. The Committee believes that this will lead to higher costs which will be borne by consumers and are particularly concerned at the impact of higher energy bills on those with low incomes. Many of the programmes are broad categories and in total they include more than 200 individual projects. This does not suggest a properly targeted and prioritised infrastructure plan. Furthermore, the statutory framework provided by the Energy Bill is coming rather late in the day when the energy crunch is fast approaching. It is likely that the UK will buy ever more energy from overseas and at a higher price due to the failure to secure investment. In these circumstances greater transparency is needed over investors' costs, risks and rewards

In this report the Public Administration Select Committee (PASC) calls for a 'People's Ombudsman' and says the Parliamentary and Health Service Ombudsman (PHSO), which investigates complaints against the NHS and other government departments and agencies, is outdated. Citizens should have direct and more user-friendly access to the Ombudsman. None of the Ombudsmen created since the PHSO's operations were established in legislation 47 years ago have adopted the same restricted model as the Parliamentary Ombudsman. As a priority, the restriction on citizens' direct and open access to PHSO, known as the MP filter, must be abolished (as is already the case in respect of NHS complaints). PHSO must be able to receive complaints other than in writing: such as in person, by telephone or online, just as is expected of any normal complaints system. PHSO should have powers to investigate areas of concern without having first to receive a complaint from a service user. Parliament should strengthen the accountability of PHSO. PASC, along with other Departmental Select Committees, should make greater use of the intelligence gathered by the PHSO to hold Government to account. A consultation should be held on the creation of a single public services ombudsman for England. At the same time, there must be a distinctive ombudsman service for UK non-devolved matters.

As one of a small number of cross-government select committees, this Committee has gained a perspective on the state of Whitehall and its agencies which is not available to departmental select committees. Throughout the past five years, the recurring theme of their findings and recommendations reflects the importance of effective leadership in creating effective organisations. It is the positive or negative attitudes and behaviour in the people and the culture of an organisation which determines success or failure. Structures, processes and systems are important too, but preoccupation with these so often becomes a distraction from the real problems, which are about why people do not share information for the common good, collaborate effectively and trust one another. PASC took control of the process of selection of the Parliamentary and Health Service Ombudsman (PHSO) away from the Government altogether, so that for the first time Parliament has appointed its Ombudsman. They have also held many pre-appointment hearings for the Chairs of public bodies and were the first Select Committee to refuse to accept a government nomination for the chair of a public body. The Government was forced to re-run the selection for the post of Chair of the UK Statistics Authority under a new selection panel, and to propose a different candidate. They also hold hearings on PHSO's thematic reports, to interrogate and hold to account those who must respond to its recommendations. PASC has worked together effectively as a team despite political differences and the often controversial issues tackled
