LORENZO MARTÍN-RETORTILLO BAQUER, con una amplia experiencia como catedrático de Derecho Administrativo en las Universidades de Salamanca, Zaragoza y Complutense de Madrid, incluye entre sus diversas líneas de investigación la problemática de los derechos humanos, a los que ha dedicado señalada y reiterada atención, también como estudioso cualificado de la jurisprudencia del Tribunal Europeo de Derechos Humanos. Una de sus especialidades en esta línea son los temas de libertad religiosa, desde que en 1970 publicara su pequeño volumen “Libertad religiosa y orden público. Un estudio de jurisprudencia”, hasta libros más recientes, como “La afirmación de la libertad religiosa en Europa (2007), o “Los padres tendrán derecho a escoger el tipo de educación que habrá de darse a sus hijos” (2008). Entre sus obras más recientes pueden señalarse, “Los derechos fundamentales y la Constitución” (2009), “Del Derecho administrativo de nuestro tiempo” (2010) y “La doctrina del Tribunal Europeo de Derechos Humanos sobre el entorno de ETA” (2011). El afianzamiento de la libertad de conciencia como una de las características de la sociedad de nuestro tiempo, con la pluralidad de opciones que se abren a la libertad religiosa, hará que periódicamente aparezcan problemas y tensiones que interesan vivamente a la opinión pública. El presente volumen reúne diez estudios recientes que el autor ha ido dedicando los últimos años a algunas cuestiones candentes, que han llegado incluso a los más cualificados Tribunales, y que fuerzan a meditar sobre las opciones y límites de la libertad religiosa, como el tema de vestimentas y atuendos de significado religioso, la objeción de conciencia, los partidos políticos que propugnan el integrismo religioso, la construcción de templos y sus relaciones con el urbanismo o los símbolos religiosos en actos institucionales y espacios públicos. La reflexión académica tratará de apoyarse así en las aportaciones jurisprudenciales para concretar el alcance efectivo de las normas y hallar espacio para una adecuada convivencia entre las distintas sensibilidades religiosas.
