Históricamente, y en nombre del progreso de la ciencia, se ha abusado y manipulado a ciertos grupos de personas, sometiéndolas a experimentos biomédicos: prisioneros, niños, pobres, enfermos mentales, soldados, ancianos, minorías étnicas... En este libro se identifican y discuten, partiendo de ejemplos prácticos, los problemas éticos que plantea la investigación biomédica cuando se realiza con estos grupos vulnerables de la población. La medicina actual necesita llevar a cabo rigurosos procesos de validación científica para legitimar sus intervenciones. Durante tales procedimientos, a menudo es inevitable someter a individuos a intervenciones cuyos riesgos y beneficios todavía se desconocen. La investigación biomédica -o experimentación con seres humanos- genera conocimientos esenciales para el tratamiento y la curación de millones de personas. Ahora bien, el método que emplea implica con frecuencia la instrumentalización de muchos sujetos, que ponen su cuerpo y su salud al servicio del interés común. Por eso, la investigación biomédica, siendo moralmente necesaria, también es éticamente cuestionable. David Rodríguez-Arias Vailhen es profesor ayudante de Filosofía Moral en la Universidad de Salamanca. Es autor de varios ensayos en revistas de bioética y, en esta colección, del libro Una muerte razonable (2005). Grégoire Moutel es médico y profesor en la Facultad de Medicina de Paris-5, donde coordina el máster Recherche en Éthique. Es secretario de la Société Française et Francophone d'Éthique Médicale (SFFEM). Ha publicado numerosos artículos sobre la relación clínica y la toma de decisiones en el principio y el final de la vida. Christian Hervé es profesor de medicina legal y de derecho sanitario. Dirige dos másters y el Laboratoire d'Éthique Médicale en la Universidad Paris-5. Ha fundado el website www.ethique.inserm.fr.

"Non-contractual liability arising out of damage caused to another" is one of the three main non-contractual obligations dealt with in the DCFR. The law of non-contractual liability arising out of damage caused to another (in the Common Law known as tort law or the law of torts, but in most other jurisdictions referred to as the law of delict) is the area of law which determines whether one who has suffered a damage can on that account demand reparation (in money or in kind) from another with whom there may be no other legal connection than the causation of damage itself. Besides determining the scope and extent of responsibility for dangers of one's own or another's creation, this field of law serves to protect fundamental rights in the private law domain, that is to say horizontally between citizens inter se. Based on pan-European comparative research which annotates the work, this volume presents model rules on liability. Explanatory comments and illustrations amplify the policy decisions involved.
