La transposition de la 3ème directive européenne, du 26/10/2005 sur la lutte contre le blanchiment d'argent, est effective depuis l'ordonnance n° 2009-104 du 30/01/2009 relative à la prévention de l'utilisation du système financier aux fins de blanchiment de capitaux et de financement du terrorisme. À cela s'ajoute la 4e directive « anti-blanchiment » du 20/05/2015 qui devra être transposée par les États membres dans un délai de 2 ans.(...) De plus, dans quelle mesure la transposition de la 3e directive européenne retenue par le droit pénal français était la seule transposition possible ou, du moins, la plus pertinente ? L'analyse de l'ordonnance de 2009 ne doit-elle pas justement permettre de prévoir des améliorations pour la transposition de la 4e directive ? Enfin, la véritable solution n'est-elle pas l'adoption d'une incrimination internationale de blanchiment ? D'une actualité brûlante, cette étude rigoureuse démontre que la lutte anti-blanchiment est à parfaire à bien des niveaux, tant au niveau national qu'international. Des mesures uniquement nationales ou européennes, sans harmonisation ni coopérations internationales, ne permettront pas de lutter efficacement contre ce phénomène, d'autant que les criminels, eux aussi, adaptent leurs techniques. Rappelant quinze années d'avancées multiples mais disparates, l'auteur prouve l'urgente nécessité d'unifier les législations et de créer une infraction de droit pénal international.
