Au débouché d’évolutions qui affectent les sciences sociales depuis une vingtaine d’années, l’étude des normes offre aux historiens un vaste champ d’enquête. L’intégration du droit, l’élargissement du concept de norme au-delà du droit, le dépassement de la confrontation entre normes et pratiques sociales en termes d’application ou d’opposition et la focalisation sur les pratiques productrices de normes ont ouvert des pistes nouvelles. C’est en suivant ces pistes que la norme est ici appréhendée en diverses « fabriques » – institutions, discours, images – au Moyen Âge et à l’époque moderne. Caractérisés par la pluralité des instances et des lieux de production des normes, ces siècles constituent un terrain propice à l’élaboration d’une réflexion comparative sur la normativité. Conjuguant les compétences de spécialistes d’histoire du droit, de la justice, d’histoire intellectuelle, religieuse et sociale, les treize études réunies dans ce volume visitent quatre grandes « fabriques de la norme » : les lieux d’élaboration des normes savantes, les « fabriques » de la loi, puis du procès, celles, enfin, des images et des apparences. À la variété des lieux correspond celle des types documentaires, des lois royales aux livrets de pèlerinage en passant par les lettres de grâce, les statuts synodaux, les délibérations municipales, les sentences de tribunaux, les Quodlibets, les textes casuistiques, l’hagiographie. Outrepassant les frontières chronologiques et disciplinaires communes, ce volume associe à une réflexion historiographique sur la normativité des études précises de cas. Il manifeste, sans prétendre l’épuiser, la réelle productivité historique de l’étude des normes.

This book adopts the proposition that it is possible to the customs to be sources of contractual obligations. To support that premise, it was necessary to seek jurisprudential (arbitration and litigation) and comparative basis. Even more, due to contract law internationalization, customary international sources should be subject of domestic treatment, as they provide contractual obligations as well as they work as contractual interpretation tool. However, one can´t neglect the need to control the customary content. In detailed terms, then, we can say that the role reserved for the custom as contractual law rules source has always been residual in Brazilian law. Accompanying the modern European experience, doctrine and Brazilian legislation emphasize the secondary, when not merely interpretive, role of the contractual custom. In turn, Brazilian case law wasn´t able to give general treatment to contractual custom. Moreover, the process of reducing distances and cultural, social and economic approximation, usually called globalization, influenced the contracts through the incorporation of a number of solutions brought from the international trade practice. Although they might be justified by the age-old principle of freedom, somehow these international "uses" insinuate themselves into Brazil to the point of requiring that the Brazilian Courts themselves to give them treatment and shelter. On one side, if you deny the existence of a creative normative role in contractual custom by another, albeit indirect, is recognized not only their existence but the possibility of foreign origin. This paradoxical treatment reflects, to some extent, another consequence: the Brazilian contract law is in the process of internationalization. Here, then, a new confrontation is announced: a broad creative freedom (a tributary of the so-called Lex mercatoria) and the foreign act incorporation control (public policy). Unlike before, however, no simplistic answer would be feasible, particularly because of the complexity of contemporary and regulatory Brazilian contract law.

For more than two centuries the idea of the nation-state has been widespread. The expression is now widely used and is even to be unavoidable. The 'nation-state' implies that the population of a state should be homogenous in terms of language, religion, and ethnicity; the nation and the state should coincide. However history demonstrates that there never has been, and there never will be, a nation-state. Human diversity is manifest in states of all sizes, locations, and origins. This wide-ranging book argues that there should be no regret in the recognition of this empirical reality, since the notion of a nation-state has been the justification for some of the worst atrocities in human history. Since the nation-state is impossible, all states are cosmopolitan in character. They are cosmopolitan regardless of the language of their constitutions or official teaching and regardless of the extent to which they officially recognize their own diversity. The most successful states are those which are most successful in their own forms of cosmopolitanism. Cosmopolitan ways are infinitely varied, however, and must be sought in the intricate workings of individual states. The cosmopolitan character of states is necessarily reflected in their law. The main instruments of legal cosmopolitanism have been those of common laws, constitutionalism, and what is best described as institutional cosmopolitanism. The relative importance of these legal instruments has changed over time but all three have been constantly operative, even in times of attempted national and territorial closure. All three remain present in the contemporary cosmopolitan state, understood in terms of cosmopolitan citizens, cosmopolitan sources and cosmopolitan thought. The cosmopolitan state is, moreover, the only appropriate conceptualization of the state in a time of globalization. This book outlines the subtlety of the law of cosmopolitan states, law which has survived through periods of nationalism and which provides the working methods for the reconciliation of diverse populations. Combining law, history, political science, political philosophy, international relations, and the new logics, it demonstrates that the idea of the nation-state has failed and should yield to an understanding of the state as necessarily cosmopolitan in character. This will be invaluable reading to all those interested in constitutional law, international law, and political theory.

La thèse ici présentée propose une étude d'ensemble du phénomène. Celle-ci fait apparaître son extraordinaire variété et la complexité de son articulation avec le droit économique. La réflexion partira du constat que la normalisation se manifeste à l'ordre juridique par l'intermédiaire de formes normatives variées, qui ne se limitent pas au domaine de la normalisation technique. Dès lors, l'adoption d'une analyse conceptuelle prend tout son sens. D'une part, elle permet de dégager qu'elles sont les caractéristiques permettant d'identifier les manifestations normatives relevant, ou non, d'un processus de normalisation. D'autre part, elle précise dans quelle mesure les normes issues de la normalisation sont porteuses de normativité juridique. Une telle analyse est logiquement complétée par une approche fonctionnelle du phénomène. Celle-ci révèle la contribution de ce processus à la mise en oeuvre du droit économique et précise dans quelle mesure il peut participer à sa création. Néanmoins l'articulation de la normalisation avec le droit économique ne se limite pas à la contribution de la première au second.
