Why are non-state actors sometimes granted participation rights in international organizations? This book argues that IOs, and the states that compose them, systematically pursue their interests when granting participation rights to NSAs. This book demonstrates that NSAs have long been participants in global governance institutions, and that states and bureaucracies have not always resisted their inclusion. At the same time, this study encourages skepticism of the assumption that increasing participation should be expected with the passage of time. The result is a study that challenges some commonly held assumptions about the interests of IOs and states, while providing an interesting comparison of secretariat and state interests with regard to one particular aspect of IO institutional rule and practice: the participation of non-state actors. Addressing the regular assumption that the power of states and the efficacy of multilateral governance have simply wilted in the heat of globalization while NSAs have flourished, this work features analysis of key institutions such as UNCEF, UNDP and the Environment Programme. It will be of great interest to students and scholars of international relations, the United Nations, and NGOs.

German Environmental Law addresses scholars, lawmakers, administrators, investors, & protectionists from outside Germany who do not read German but wish to have access to the sources of German environmental law. The major law texts concerning nature conservation, air quality control, water protection, waste management, road planning, environmental impact assessment & environmental liability are reproduced. Also included are the Technical Instructions on Air Quality Control, an administrative guideline of great practical importance, which is often taken as a point of reference for the construction of industrial plants, even outside Germany. The law texts are accompanied by a case-related introduction to German environmental law. While there are numerous introductions to & editions of German environmental law in the German language, this book is the first to outline German environmental law & reproduce the basic law texts in the English language.

The purpose of these volumes is to examine, explain and appraise contributions made by the United Nations system to international law and the law-creating process. The work assesses the effect UN institutions have had on the law-making process, and the extent to which that law has been accepted by and evidenced in contemporary state practice. It is divided into three main parts. The first examines the practical as well as conceptual aspects of the UN system as a source of law. The second part deals with different fields of activity which have become the subjects of legal rules and processes. Areas covered include human rights, use of force and economic relations. In addition, topics that have not previously been examined in such a comprehensive manner, such as shipping, aviation, and private international law, are also discussed. The third part covers the internal law of the UN system - international civil services and financial contributions.

International Environmental Governance: Towards UNEPO offers a significant contribution to practitioners and scholars involved in international debates regarding environmental governance. Clarifying the insufficiency of the 1972 UN General Assembly’s model of a small UN Environment Programme in helping nations stem the accumulating degradation of the environment across the globe, the work poses the remaining question: how should international environmental governance be accomplished? The volume is timely in its examination of the post-Rio+20 period, and furthermore addresses the vital issue of the evolution of UNEP into a ‘specialized agency’ designated the UN Environment Protection Organization (UNEPO), a ‘new mandate’ to revive the UN Trusteeship Council to supervise environment and the commons, as well as law-making and institution-building processes as reflected in multilateral environmental agreements (MEAs) and other multilateral forms. International Environmental Governance: Towards UNEPO addresses the law-making challenge presented by growth in MEAs and proliferation of international environmental institutions, with a thorough consideration of the debate regarding the need for and efficacy of global governance in the field of environment. Dr. Desai’s timely analysis will assist diplomats, lawyers and scholars, citizens and civil servants alike in finding the new roads forward.
