Essay from the year 2016 in the subject Politics - Topic: Public International Law and Human Rights, grade: 5.5/6, , language: English, abstract: During the armed conflict of non-international character between the Federal Republic of Yugoslavia (FRY) and the Kosovo Liberation Army (UCK), the intervention of NATO against the FRY supposed the internationalization of the conflict for all the parties. NATO decided to intervene in this conflict against the forces of the FRY arguing that they were neither supporters of the UCK, nor against Serbia. Indeed, they stated that their operations were in order to prevent a “humanitarian catastrophe”. Even if they used this label and stressed that they were not making war, their intervention was later on traduced in military operations based mainly on air attacks. The Security Council never authorized this intervention. Besides, NATO was accused in many occasions of nonrespecting the rules of International Humanitarian Law (Hereinafter “IHL”). The present paper will discuss the following questions: What is the legal status of NATO? What IHL instrument is NATO bound by as an organization? What are the IHL obligations of States when acting on behalf of NATO? How do NATO and States conjugate their different obligations under IHL during their interventions? How to make accountability for IHL breaches committed by NATO and the Allies?

This report examines the reasons Slobodan Milosevic, the then president of the Federal Republic of Yugoslavia, decided on June 3, 1999, to accept NATO's conditions for terminating the conflict over Kosovo. Drawing in part upon the testimony of Milosevic and other senior Serb and foreign officials who directly interacted with Milosevic, the report analyzes (1) the assumptions and other calculations that underlay Milosevic's initial decision to defy NATO's demands with regard to Kosovo, and (2) the political, economic, and military developments and pressures, and the resulting expectations and concerns that most importantly influenced his subsequent decision to come to terms. While several interrelated factors, including Moscow's eventual endorsement of NATO's terms, helped shape Milosevic's decision to yield, it was the cumulative effect of NATO air power that proved most decisive. The allied bombing of Serbia's infrastructure targets, as it intensified, stimulated a growing interest among both the Servian public and Belgrade officials to end the conflict. Milosevic's belief that the bombing that would follow a rejection of NATO's June 2 peace terms would be massively destructive and threatening to his continued rule made a settlement seem imperative. Also examined are some implications for future U.S. and allied military capabilities and operations.

On 24 March 1999, NATO initiated military action against the Federal Republic of Yugoslavia in response to the crisis in Kosovo. Operation Allied Force was conducted without the explicit authorization of the United Nations Security Council, but was justified by NATO allies as a means to bring peace and stability to Kosovo, and to prevent a greater humanitarian emergency from developing. In the absence of specific U.N.S.C. authorization, was NATO's violation of Yugoslavia's sovereignty through the use of force illegitimate? Or were the potential humanitarian consequences of inaction by NATO so disastrous as to make intervention a moral imperative, despite the stipulations of the U.N. Charter? These questions-still under debate-highlight the dilemma facing the NATO allies on the eve of Operation Allied Force. This thesis examines Operation Allied Force and how the most influential NATO allies (Britain, France, Germany, and the United States) justified the use of force in the Kosovo crisis without relying on an explicit U.N. Security Council mandate for such action. In addition, it considers whether NATO's intervention in the Kosovo conflict established a new precedent whereby U.N. Security Council authorization of the use of force is no longer a prerequisite for forceful humanitarian intervention.
