Este libro es un ensayo sobre las contradicciones fácticas en el marco de distintos procesos. En particular, sobre las que pueden producirse entre procesos civiles, laborales o de cualquier otra índole posteriores a un proceso penal. En la década de los ochenta del siglo pasado el Tribunal Constitucional entendió contrario a la lógica jurídica y a la propia Constitución este tipo de contradicciones fácticas: «Unos mismos hechos –sostuvo– no pueden existir y dejar de existir para los órganos del Estado». Esta afirmación, lejos de ser inocua, tuvo profundas repercusiones legales y jurisprudenciales que llegan a nuestros días. Tanto es así que, apoyada en aquella consideración del Tribunal Constitucional, existe hoy la muy extendida idea de que los tribunales se encuentran vinculados por el juicio fáctico realizado previamente por otros tribunales. Desde las páginas de este libro se rebate la «máxima» del Tribunal Constitucional que, llevada a sus últimas consecuencias, arriesga la independencia judicial y, lo que aún es más grave, el derecho de defensa.

El presente manuscrito es una compilación de diversas Locuciones Latinas en Materia Jurídica. No es una guía de Derecho. Tampoco una exposición doctrinaria de las locuciones plasmadas, sólo se busca mostrar sencillamente, algunas locuciones y vocablos visualizados en diversos textos, cuyos autores se exponen en la bibliografía, haciendo con mucho respeto hacia ellos. De inicio se muestra un capítulo de "introducción", con lo que se busca explicar la importancia del contenido, se detalla una "breve historia romana" alusiva a los "orígenes de la península italiana", los "pueblos que conformaron la península itálica", sobre todo los pueblos que se establecieron en la región del Lazio, (centro-sur de Italia), los etruscos, (norte-centro de Italia) y los colonizadores griegos que se establecieron en el sur de Italia, todos ellos contribuyeron al crecimiento de Roma a partir de su fundación en el siglo VIII a.C. La obra de "Rómulo y Remo", "La Monarquía", "La República, "El Imperio" (sus emperadores y su ocaso); cómo surge el "Derecho Romano", y "el uso del latín en el derecho". Con la explicación breve en cada una de las locuciones y vocablos, (de las de mayor importancia), se busca explicar el sentido de las mismas, es decir, lo que pensaron y quisieron decirnos los antiguos jurisconsultos romanos. De manera general, se muestra brevemente la historia romana, la conformación del Derecho y las locuciones con una breve explicación.

Spanish Golden Age drama as an expression of morality falls between the extremes of art-for-art's-sake and utilitarianism. According to Spanish literary critics of the 16th and 17th centuries, drama imitated reality, the subject and domain of philosophy. The integration of drama and scholastic moral philosophy was an important aspect of the critical theory of this era, which held that art should both teach and delight. Through close textual analysis of representative plays, this book examines the artistic fusion of natural-law philosophy and drama. It demonstrates the relationship between ethics and the central ideological themes of these works, illustrating that an awareness of the doctrines of natural law ethics is crucial to an enriched comprehension of the drama of Golden Age Spain.
