Millions of female migrants experience various forms of exploitative and unsafe conditions when migrating for employment and income generation, both in countries of origin and in destination countries. Vulnerabilities increased further due to the Covid-19 pandemic, causing income and job losses, entrapment in countries of destination without financial or social support and stigmatization upon return. One of the key migration routes travelled by millions of migrants is from South Asia to the Middle East. We examine this migration route for low-skilled female migrant workers highlighting the impacts of interventions along the migration pathway to determine the effectiveness of alternative mechanisms for reducing forced labour and trafficking. We draw lessons from the literature as well as from interviews with key informants in the field, including academics, development partners, NGO workers, and policymakers, to identify promising interventions that successfully reduce the vulnerability of women migrants. We find that, while Covid-19 has increased migrant vulnerability, it has also exposed the current system’s violations in facilitating trafficking and exacerbating poor working conditions.

This book is an exploration of the relationship between irregular migrants, many originating from southern Philippines and the sea, in their struggle against the realities of state power in Sabah. As their numbers grow exponentially into the 21st century, the only solution currently provided by the Malaysian government is routine repatriation. Yet, despite increased border security, they continue to return. Thus the question: why do deported migrants return, time and again, despite the serious risk of being caught? This book explores the ways in which these irregular migrants contest inconvenient national sea boundaries, the trauma of detention and deportation, and other impositions of state power by drawing on supernatural support from the sea itself. The sea empowers them, and through individual narratives of the sea, we learn that the migrants’ encounter with the state and its legal system only intensifies rather than discourages their relationship with the Malaysian state.

This book explores the developing relationship between statelessness and migration. Migration law is setting the new parameters for international protection. Irregular migration is producing new forms of statelessness. International conventions on statelessness, refugees and migrant workers and international human rights instruments do not provide effective protection for these contemporary groups of stateless persons. The case study of Burmese irregular migrant workers in Thailand demonstrate that women and children are among the most unprotected because of the gendered construction of statelessness. The book concludes firstly that the 1999 CEDAW Protocol is an avenue through which stateless women may pursue redress. Secondly, it argues that it is imperative to set international law limits on state powers over immigration matters.
