¿Cuánto cuesta al Estado poner en valor el arte, la cultura y patrimonio cultural en todas y cada una de sus manifestaciones, haciéndola accesible y visible al ciudadano y promoviendo el desarrollo de la cultura?, ¿cuál es el valor del patrimonio cultural?, ¿cómo conciben los poderes públicos el arte, los bienes patrimonio-histórico culturales? ¿son públicos intrínsecamente o debe ser neutro el Estado cuando rozan los derechos de propiedad privada sobre esos bienes? No cabe la menor duda que vivimos un tiempo de fuerte democratización de la cultura, al menos entendida la misma como un derecho de acceso por parte de todos al arte, al patrimonio, lo que implica de suyo, un hacer, un mandato constitucional a los poderes públicos para que la misma sea una realidad. Otra cuestión será valorar justa y equitativamente esta dimensión. ¿Qué entendemos en verdad por patrimonio cultural?, o desde otro vértice, ¿qué entendemos por cultura?, ¿quid por una obra de arte frente a un objeto cultural?, ¿son lo mismo o significan por igual los términos cultura y arte? O ¿acaso no existe en verdad una visión elitista de la cultura? En último caso un interrogante es claro, ¿de quién y para quién es la cultura? ¿Quién posee o puede poseer el arte y la cultura y quién tiene derecho y debe disfrutarlo? ¿Es rentable la compra de obras de arte por parte de los poderes públicos? ¿Hablamos de democracia cultural o de desarrollo cultural a cargo de los poderes públicos? ¿Y la economía cultural?, ¿acaso no es una tarea o un ámbito donde han de estar implicados tanto actores públicos como privados o particulares?, ¿debe el Estado o los poderes públicos suplir la inactividad, aunque la misma sea parcial, de la iniciativa privada en el desarrollo de la cultura?, ¿o debemos transitar hacia una cooperación no conflictual y sí eficiente y racional económicamente en la tutela y promoción del arte y la cultura con los entes o personas privadas Esta obra completa el catálogo de Thomson-Reuters Aranzadi.

Una de las cuestiones hoy más novedosas en el mundo del arte es trazar, conocer y, sobre todo, hacerlo con cierta nitidez, el impacto que lo digital y más en concreto, la inteligencia artificial, está teniendo en el mercado del arte. Un impacto que no solo se ha de traducir desde la vertiente del valor económico de la creación u obra en sí, típica de los sistemas anglosajones, cuánto desde la vertiente de la creación y los derechos de autor con su dimensión moral. Sin olvidar la connotación que lo digital tiene como canal, instrumento o herramienta de creación y, en suma, de generación de valor. No solo valor cultural sino un explícito valor patrimonial. Y esto abre significativos horizontes que pasan, primero, por enuclear, bajo un único paraguas o no, la noción y el alcance mismo de lo que es en realidad "obra de arte"; en segundo lugar, cuestiones de autoría y tutela, amén de seguridad jurídica que no dista de contestar valiente y eficientemente a un nuevo interrogante, a saber, ¿a quién se imputa la autoría cuando la obra, la "obra de arte" es creada por un sistema de inteligencia artificial?, quién crea en definitiva, ¿la máquina, el programador, el usuario o el proveedor de datos de la inteligencia artificial.

El pensamiento neoestructuralista de la CEPAL es dinámico, abierto y se renueva permanentemente sin perder su tradición estructuralista. El libro aporta también elementos conceptuales para formular un neoestructuralismo ecológico.

In any country where there is a Bill of Rights, constitutional rights reasoning is an important part of the legal process. As more and more countries adopt Human Rights legislation and accede to international human rights agreements, and as the European Union introduces its own Bill of Rights, judges struggle to implement these rights consistently and sometimes the reasoning behind them is lost. Examining the practice in other jurisdictions can be a valuable guide. Robert Alexy's classic work reconstructs the reasoning behind the jurisprudence of the German Basic Law and in doing so provides a theory of general application to all jurisdictions where judges wrestle with rights adjudication. In considering the features of constitutional rights reasoning, the author moves from the doctrine of proportionality, procedural rights and the structure and scope of constitutional rights, to general rights of liberty and equality and the problem of horizontal effect. A postscript written for the English edition considers critiques of the Theory since it first appeared in 1985, focusing in particular on the discretion left to legislatures and in an extended introduction the translator argues that the theory may be used to clarify the nature of legal reasoning in the context of rights under the British Constitution.
