The Land (Titles) Strata Act in Singapore does not provide for the manner in which share values in a strata title scheme are to be decided. Share values are subject to the approval of the Commissioner of Buildings who has issued certain guidelines on the matter. This paper is intended to examine in particular, though not exclusively, mixed-use developments in the light of the existing guidelines and why it is desirable to consider other relevant factors in the determination of share values, upon which three separate and divergent matters are dependent. These are the voting right of an owner of a unit, his contribution for maintenance of the common property and his entitlement as to a share in the common property after dissolution of the scheme. There may be a case for a share value to be determined in respect of each of the three matters set out above, rather than a single share value as is the present position. The objective is to ensure equity and fairness among the owners of units within a strata title scheme.
