Summary: In 1830 werd met de stichting van België wellicht de eerste moderne natiestaat op het Europese vasteland gevestigd. Die natiestaat was bijzonder stabiel; de grondwet bleef, op twee uitbreidingen van het stemrecht na, 140 jaar ongewijzigd. Met de gedrevenheid waarmee de revolutie tot stand was gekomen, ontstond een stroming die de nationale kunst en literatuur wilde stimuleren, de geschiedenis bestuderen, de volkstaal beoefenen en de vaderlandse tradities in ere houden. De beginnende Vlaamse beweging was een onderdeel van dat Belgische patriottisme. Sinds de eerste helft van de 20ste eeuw wordt de herinnering aan dat gezamelijke Belgische verleden stevig ontwricht door de flamingantische ideologie die een Vlaamse tegenhegemonie tegenover de Belgische natie en haar verleden heeft geschapen. Het verleden van België wordt zeker in Vlaanderen niet meer gekoesterd. België is vandaag uit vele Vlaamse, maar ook uit steeds meer Waalse geesten verdwenen. Vlaanderen is vandaag méér dan België een natie, Wallonië volgt met rasse schreden.

In de periode 1830-1914 waren de nationale feesten een hoogtepunt in het politieke, culturele en maatschappelijke leven van de jonge Belgische staat. De Revolutie van 1830, de grondwet en de monarchie 'bekampten' elkaar om als het nationale symbool bij uitstek te worden beschouwd. Dit leidde ertoe dat het feest van de natie eerst in september, daarna in augustus en uiteindelijk op 21 juli werd gevierd. Elk jaar opnieuw poogde de overheid het enthousiasme van de bevolking en de bewondering van het buitenland op te wekken. De vaderlandsliefde van de Belgen, de eenheid van het land, de heroïek en de pracht van het eigen verleden, het artistieke patimonium, de industriële vooruitgang, de economische welvaart en de militaire macht van de natie werden uitvoerig bejubeld. De natie betuigde haar loyaliteit ten aanzien van het vaderland, de dynastie en de grondwet, waardoor de levensbeschouwelijke, sociale en communautaire spanningen en conflicten op rituele wijze werden bezworen. Toch kwamen de breuklijnen ook juist naar aanleiding van de nationale feesten aan de oppervlakte. De verheerlijking en legitimatie van de Belgische natie kenden dan ook niet altijd een vlekkeloos verloop.

This book deals with the development of private secondary schooling during the Second World War in Belgium. It focuses on how the German occupier used education to gain acceptance of the regime, and discusses the attitudes of Belgian education authorities, schools, teachers and pupils towards the German occupation. Suggesting that the occupation forced Belgian education authorities, such as the Roman Catholic Church, to take certain positions, the book explores the wartime experiences and memories of pupils and teachers. It explains that the German Culture Department was relatively weak in establishing total control over education and that Catholic schools were able to maintain their education project during the war. However, the book also reveals that, in some cases, the German occupation did not need total control over education in order to find support for some authoritarian ideas. As such, Van Ruyskenvelde’s analysis presents a nuanced view of the image of the Catholic Church, schools, teachers and pupils as mere victims of war.

This second volume of ReConFort, published open access, addresses the decisive role of constitutional normativity, and focuses on discourses concerning the legal role of constitutional norms. Taken together with ReConFort I (National Sovereignty), it calls for an innovative reassessment of constitutional history drawing on key categories to convey the legal nature of the constitution itself (national sovereignty, precedence, justiciability of power, judiciary as constituted power). In the late 18th and early 19th centuries, constitutional normativity began to complete the legal fixation of the entire political order. This juridification in one constitutional text resulted in a conceptual differentiation from ordinary law, which extends to alterability and justiciability. The early expressions of this ‘new order of the ages’ suggest an unprecedented and irremediable break with European legal tradition, be it with British colonial governance or the French ancien régime. In fact, while the shift to constitutions as a hierarchically ‘higher’ form of positive law was a revolutionary change, it also drew upon old liberties. The American constitutional discourse, which was itself heavily influenced by British common law, in turn served as an inspiration for a variety of constitutional experiments – from the French Revolution to Napoleon’s downfall, in the halls of the Frankfurt Assembly, on the road to a unified Italy, and in the later theoretical discourse of twentieth-century Austria. If the constitution states the legal rules for the law-making process, then its Kelsian primacy is mandatory. Also included in this volume are the French originals and English translations of two vital documents. The first – Emmanuel Joseph Sieyès’ Du Jury Constitutionnaire (1795) – highlights an early attempt to reconcile the democratic values of the French Revolution with the pragmatic need to legally protect the Revolution. The second – the 1812 draft of the Constitution of the Kingdom of Poland – presents the ‘constitutional propaganda’ of the Russian Tsar Alexander I to bargain for the support of the Lithuanian and Polish nobility. These documents open new avenues of research into Europe’s constitutional history: one replete with diverse contexts and national experiences, but above all an overarching motif of constitutional decisiveness that served to complete the juridification of sovereignty.
