Wanneer men vragen van derdenwerking dan nog voorgeschoteld krijgt in gevallen van cessie en schuldoverdracht, wordt het helemaal spannend, niet alleen voor de magistraten die hierover recent uitspraak moesten doen. 00Vervolgens wordt stilgestaan bij de figuren voorwerp en oorzaak. Het belang ervan kan moeilijk worden onderschat: zowel voor de geldige totstandkoming als voor het voortbestaan van overeenkomsten zijn zij van cruciaal belang. Uit de recente rechtspraak blijkt dat de materie bovendien volop in beweging is. 00Daarna komen de belangrijkste beëindigingsbedingen aan de beurt: de opzegbedingen, de uitdrukkelijk ontbindende bedingen en de ontbindende voorwaarden. Met deze bedingen kan men ervoor zorgen dat ondernemingen en advocaten een vlotte, buitengerechtelijke beëindiging van overeenkomsten organiseren. Maar een tussenkomst van de rechter kan hierbij nooit helemaal uitgesloten worden en het komt erop aan in de praktijk te anticiperen op een mogelijke controle a posteriori. 00Tot slot komen enkele hete hangijzers van de uitvoering en de remediëring van contracten aan de beurt: de remedies bij toerekenbare tekortkoming (de ontbinding en de uitvoering van het contract) en de gevolgen van overmacht (schorsing en bevrijding).
