Logo após a redemocratização, muitos países latino-americanos instituíram comissões da verdade e investigaram os fatos ocorridos. O Brasil, entretanto, não seguiu esses passos. Nesse contexto, o presente livro objetiva apresentar os fundamentos para a construção de uma teoria geral da justiça de transição, além de caracterizar o direito à verdade e o direito à memória como direitos fundamentais. This book elaborates a new framework for considering and understanding the relationship between law and memory. How can law influence collective memory? What are the mechanisms law employs to influence social perceptions of the past? And how successful is law in its attempts to rewrite narratives about the past? As the field of memory studies has grown, this book takes a step back from established transitional justice narratives, returning to the core sociological, philosophical and legal theoretical issues that underpin this field. The book then goes on to propose a new approach to the relationship between law and collective memory based on a conception of ‘legal institutions of memory’. It then elaborates the functioning of such institutions through a range of examples – taken from Japan, Iraq, Brazil, Portugal, Rwanda and Poland – that move from the work of international tribunals and truth commissions to more explicit memory legislation. The book concludes with a general assessment of the contemporary intersections of law and memory, and their legal institutionalisation. This book will be of interest to scholars with relevant interests in the sociology of law, legal theory and international law, as well as in sociology and politics.

Cultural and natural heritage are central to ‘Europe’ and ‘the European project’. They were bound up in the emergence of nation-states in the eighteenth and nineteenth centuries, where they were used to justify differences over which border conflicts were fought. Later, the idea of a ‘common European heritage’ provided a rationale for the development of the European Union. Now, the emergence of ‘new’ populist nationalisms shows how the imagined past continues to play a role in cultural and social governance, while a series of interlinked social and ecological crises are changing the ways that heritage operates, with new discourses and ontologies emerging to reconfigure heritage for the circumstances of the present and the uncertainties of the future. Taking the current role of heritage in Europe as its starting point, Critical Heritage Studies and the Futures of Europe presents a number of case studies that explore key themes in this transformation.
