O direito ao esquecimento é um direito fundamental de personalidade inserido na denominada quinta dimensão dos direitos fundamentais. Advém do contexto da sociedade de informação e das transformações tecnológicas ocorridas desde a Segunda Grande Guerra Mundial. É amparado no princípio da dignidade humana, apresentando partes em comum com os direitos à privacidade, à autodeterminação informativa e ao livre desenvolvimento da personalidade. O direito ao esquecimento não tem o objetivo de reconstruir a própria história ou modificar a vida pretérita do titular. Visa, tão somente, na medida do possível, alterar a forma como o sujeito é representado perante o próprio meio em que vive, em conformidade com seu novo momento de vida ou em razão da identidade dinâmica. Como todo direito, o direito ao esquecimento apresenta restrições quando se está em discussão o exercício da liberdade de expressão e informação; o interesse público; âmbito territorial de aplicação e as ofensas ambientais. Por tais gravidades, as ofensas ambientais nunca podem ser esquecidas, principalmente, em razão: da primazia do direito do ambiente; da prevalência da memória coletiva; da necessidade de preservação da dignidade ecológica; do elevado nível de proteção do ambiente e do atendimento dos interesses das gerações futuras em conhecer o que ocorreu para não se cometer os mesmos erros do passado.

One of the most important political and ethical questions faced during a political transition from authoritarian or totalitarian to democratic rule is how to deal with legacies of repression. Indeed, some of the most fundamental questions regarding law, morality and politics are raised at such times, as societies look back to understand how they lost their moral and political compass, failing to contain violence and promote the values of tolerance and peace. The Politics of Memory sheds light on this important aspect of transitional politics, assessing how Portugal, Spain, the countries of Central and Eastern Europe and Germany after reunification, Russia, the Southern Cone of Latin America and Central America, as well as South Africa, have confronted legacies of repression. The book examines the presence - or absence - of three types of official efforts to come to terms with the past: truth commissions, trials and amnesties, and purges. In addition, it looks at unofficial initiatives emerging from within society, usually involving human rights organisations (HROs), churches or political parties. Where relevant, it also examines the 'politics of memory,' whereby societies re-work the past in an effort to come to terms with it, both during the transitions and long after official transitional policies have been implemented or forgotten. The book also assesses the significance of forms of reckoning with the past for a process of democratization or democratic deepening. It also focuses on the role of international actors in such processes, as external players are becoming increasingly influential in shaping national policy where human rights are concerned.

It argues that the central concern of Romans is with the question of justice, a justice that must be thought outside of law on the basis of grace or gift. The many perplexities that arise from thus trying to think justice outside of law are clarified by reading Derrida on such themes as justice and law, gift and exchange, duty and debt, hospitality, cosmopolitanism, and pardon. This interweaving of Paul and Derrida shows that Paul may be read as a thinker who wrestles with real problems that are of concern to anyone who thinks. It also shows that Derrida, far from being the enemy of theological reflection, is himself a necessary companion to the thinking of the biblical theologian. Against the grain of what passes for common wisdom this book argues that both Derrida and Paul are indispensable guides to a new way of thinking about justice.

At the end of World War II, several Latin American countries seemed to be ready for industrialization and self-sustaining economic growth. Instead, they found that they had exchanged old forms of political and economic dependence for a new kind of dependency on the international capitalism of multinational corporations. In the much-acclaimed original Spanish edition (Dependencia y Desarrollo en América Latina) and now in the expanded and revised English version, Cardoso and Faletto offer a sophisticated analysis of the economic development of Latin America. The economic dependency of Latin America stems not merely from the domination of the world market over internal national and "enclave" economies, but also from the much more complex interact ion of economic drives, political structures, social movements, and historically conditioned alliances. While heeding the unique histories of individual nations, the authors discern four general stages in Latin America's economic development: the early outward expansion of newly independent nations, the political emergence of the middle sector, the formation of internal markets in response to population growth, and the new dependence on international markets.
