Eine ambulante Regelbehandlung im Krankenhaus ist im deutschen Gesundheitswesen für gesetzlich Versicherte nicht möglich. Der Regelzugang von GKV-Versicherten erfolgt – bis auf Ausnahmen – über die Einweisung eines niedergelassenen Arztes. Erste zaghafte Ansätze, Krankenhäuser für ambulante Behandlungen zu öffnen, gab es bereits in den 90er Jahren mit dem Gesundheitsstrukturgesetz. Im GKV-Modernisierungsgesetz (GMG) von 2003 wurde die Möglichkeit ge-schaffen, hoch spezialisierte Leistungen ambulant anzubieten, sofern vorher ein entsprechender Vertrag mit der einzelnen Krankenkasse abgeschlossen wurde: Es kam jedoch nur in sehr geringem Umfang zu entsprechenden Ver-tragsabschlüssen. Typische Schnittstellenprobleme zwischen stationärem und ambulantem Sektor blieben weitgehend bestehen. Für HIV/Aids-Patienten mit CMV-Retinitis stellte dieses Schnittstellenproblem eine besondere Härte dar, da nach einer mehrwöchigen stationären Akutbehandlung eine mehrmonatige dosisreduzierte Sekundärprophylaxe (Erhaltungstherapie) durchgeführt werden muss. Dies kann nur durch HIV-erfahrene Ophtalmologen sichergestellt werden. Fehler wären überaus verhängnisvoll, da einmal eingetretene Sehkraftverluste nicht wieder hergestellt werden können. Das GKV-Wettbewerbsstärkungsgesetz trat am 01.04.2007 in Kraft. Ein As-pekt dieser Gesundheitsreform ist, dass die bestehenden Möglichkeiten zur ambulanten Leistungserbringung am Krankenhaus (hoch spezialisierte Leis-tungen gemäß dem Katalog nach § 116b Absatz 3 und 4 SGB V) konsequen-ter umgesetzt werden können. Vor der Gesetzesänderung und den neuen Möglichkeiten des GKV-WSG hätte der Patient nach seiner stationären Behandlung in die ambulante Behandlung außerhalb des Krankenhauses wechseln müssen. Zwar gab es auch schon vor dem Inkrafttreten die Möglichkeit, dass Krankenhäuser ambulante Behandlungen durchführen, dies war jedoch immer an verschiedene Bedingungen und Voraussetzungen ge-bunden. Die ambulante Versorgung wird regelmäßig durch niedergelassene Ärzte wahrgenommen, die nur in vergleichsweise seltenen Fällen die für die Erhaltungstherapie ausreichende Behandlung ihrer Patienten fortsetzen.
