Et comment concevoir les contours d'une communauté de valeurs par-delà la diversité des cultures et l'opposition des intérêts ? Explorant d'une part les interdits fondateurs (crimes internationaux), d'autre part les droits fondamentaux (droits de l'homme et biens publics mondiaux), Mireille Delmas-Marty n'entend pas éradiquer les différences mais relativiser le relativisme. À la recherche d'une unité de sens, dans la perspective d'un humanisme nouveau, pluriel et ouvert, elle montre que le droit peut contribuer à nourrir l'idée de bien commun. Mireille Delmas-Marty, qui a enseigné le droit à l'Université (Lille II, Paris XI et Paris I), est titulaire de la chaire " Études juridiques comparatives et internationalisation du droit " au Collège de France. Elle est notamment l'auteur de Pour un droit commun (Seuil, 1994), Vers un droit commun de l'humanité (Seuil, 1996), Trois défis pour un droit mondial (Seuil, 1998), des Forces imaginantes du droit (3 vol. parus au Seuil, 2004-2007) et de Libertés et sûreté dans un monde dangereux (Seuil, 2009). Elle est membre de l'Académie des sciences morales et politiques.

Droits de l'homme, droits du marché, crimes contre l'humanité, biens communs... : l'universalisme juridique ne donne à voir que concepts flous, valeurs conflictuelles ou normes ineffectives, alors que déjà s'estompe le relativisme des ordres nationaux. Car la corruption et le terrorisme se globalisent, les flux financiers et l'information circulent dans un espace virtuel dont la nature immatérielle brouille la notion de territoire, et les États sont aux prises avec des risques, biotechnologiques ou écologiques, devenus planétaires. Les droits nationaux ont beau résister, ils n'empêchent pas la superposition de normes et d'institutions inter- et supranationales, régionales et mondiales. Ainsi se dessinent d'étranges entrecroisements qui illustrent le grand désordre du monde, sans qu'apparaisse encore l'issue qui ouvrirait La Voie de la sagesse imaginée par le peintre Vieira da Silva. Si l'ordre juridique doit s'assembler un jour en un tableau, c'est à condition d'accepter qu'il se construise "par petites touches", selon les termes mêmes de l'artiste, qui s'obstinait à peindre "avec toutes les contradictions". On pourrait y voir une invitation à observer le droit en voie de mondialisation tout comme on peut regarder ce tableau : par fragments.
