Victims and Criminal Justice is the first study of its kind to examine both the origins and impacts of key legal, procedural, and institutional changes introduced in England and Wales to encourage and govern prosecution. It sets out how crime victims' experiences of, and engagement with, the process of criminal justice changed dramatically between the late seventeenth and late twentieth centuries. Where victims once drove the English criminal justice system, bringing prosecutions as complainants and prosecutors, giving evidence as witnesses, putting up personal rewards for the recovery of lost goods or claim rewards for securing convictions, by the end of this period, victims had been firmly displaced as the state took virtually full responsibility for the process of prosecution. Combining qualitative analysis of a range of textual sources with quantitative analysis of large datasets featuring over 200,000 criminal prosecutions, the authors explore how victims were defined in law, what the law allowed and encouraged them to do, who they were in social and economic terms, how they participated in the criminal justice system, why many were unwilling or unable to engage in that system, and why some campaigned for specific rights. In exploring the shift in victim participation in criminal trials, Victims and Criminal Justice places current policy debates in a much-needed critical historical context.

Adversarial Justice and Victims’ Rights explores the extent to which reforms that offer victims enhanced rights to information and participation across England and Wales, Ireland and South Australia can address sexual assault victims’ procedural and substantive justice concerns. The rights, status and treatment of sexual assault victims has emerged as a significant 21st-century concern, occupying the forefront of legal commentary on international policy agendas. Informed by the voices of 26 high-level criminal justice professionals, legal stakeholders and victim support workers, and a quantitative dataset, this book considers whether legal representation can address some of the problems of the prosecution process for sexual assault victims in Victoria and, indeed, in other adversarial jurisdictions that employ similar legislative frameworks. While acknowledging the value of victim-focused reforms, the book contends that cultural changes to the ways in which sexual assault victims are perceived and treated are necessary in order to improve victims’ experiences of the legal process. Reconceptualising the role of sexual assault victims from ‘witnesses’ to ‘participants’ will also increase the likelihood that victims’ rights and interests will be considered alongside those of the state and the accused. This book examines the international, regional and domestic human rights frameworks that establish victim rights as a central force in law and policy in the twenty-first century. The fight against terrorism is receiving increased awareness due to recent wor- wide large-scale terrorist acts, and only since then has some attention been directed specifically to victims of terrorism. Existing legal instruments of international b- ies like the European Union, the Council of Europe and the United Nations c- cerning victims of terrorism are relatively abstract or include victims of terrorism under the broader heading of victims of crime in general. In addition, policies and legislation relating to victims of crime or victims of terrorism vary widely on the domestic level. Against this background, the European Union commissioned a project that should aim to develop more extensive standards for the aid and ass- tance of victims of terrorism at the European level. This study provides the basis from which more extensive standards could be derived. The study focuses parti- larly on developing standards in the field of continuing assistance, access to justice, administration of justice and compensation to victims of terrorism. A novel feature of the approach is that also the possible utility of restorative justice approaches is examined. An important question to address was whether there is a real need to adopt s- cific standards for victims of terrorism, thereby implying that their needs might differ from victims of ordinary crime.
