"Recent years have seen a heightened awareness of the plight of victims of crime and of their neglect by the traditional criminal justice system with its bureaucratic and institutional processes. This concern for the victim has been shared by diverse groups, including humanists, conservative "law and order" politicians, feminists, and grassroots community advocates. This combination of forces has stimulated a mass of legislative reform at both the federal and state levels. Many jurisdictions have adopted a "Bill of Rights" for the victim; public funds have been established to compensate victims; courts have been enjoined to order offenders to make restitution; welfare agencies have developed programs to provide victims with assistance; and courts are inviting victims to testify at the sentencing hearings of their offenders." "These reforms and proposals have been accompanied by a growing body of literature that discusses the needs of victims and analyzes the merits and drawbacks of particular reforms, some of which have been evaluated empirically. What has been lacking until now is an integrated overview that looks at their philosophical underpinnings and considers how these different and sometimes conflicting proposals are conceptually related to one another and to other prevailing criminal justice doctrines and ideologies. Leslie Sebba fills this gap in Third Parties."--BOOK JACKET.Title Summary field provided by Blackwell North America, Inc. All Rights Reserved

Justice For Victims Of Crime written by Albin Dearing and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-02-06 with Law categories.

This book analyses the rights of crime victims within a human rights paradigm, and describes the inconsistencies resulting from attempts to introduce the procedural rights of victims within a criminal justice system that views crime as a matter between the state and the offender, and not as one involving the victim. To remedy this problem, the book calls for abandoning the concept of crime as an infringement of a state’s criminal laws and instead reinterpreting it as a violation of human rights. The state’s right to punish the offender would then be replaced by the rights of victims to see those responsible for violating their human rights convicted and punished and by the rights of offenders to be treated as accountable agents.

The Routledge Handbook on Victims’ Issues in Criminal Justice is a comprehensive and authoritative handbook on current issues, with a distinctive emphasis on the delivery of suitable and effective services. The editor provides an introduction and conclusion to the handbook, synthesizing original contributions from current leaders in the field, surveying victims’ rights in the United States, victim participation in the criminal justice system, victims’ welfare and needs, and most notably the services that have been developed in response. A section on special populations in the United States brings focus to current and emerging issues faced within the country, while a section covering international and transnational victimization explores globalization and the implications of other legal traditions and systems. This handbook addresses the crucial and complex topic of victims’ issues, examining both societal and governmental reactions to victims’ concerns and acquainting readers with the issues that discord may cause, and how they affect the provision of services. This book will serve as an essential reference for academics and practitioners working with crime victims, as well as for students taking courses in victimology, criminology, sociology, and related subjects.

Victims written by Ross McGarry and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2015-06-05 with Social Science categories.

The study of victims of crime is a central concern for criminologists around the world. In recent years, some victimologists have become increasingly engaged in positivist debates on the differences between victims and non-victims, how these differences can be measured and what could be done to improve the victims' experience of the criminal justice system. Written by experts in the field, this book embraces a much wider understanding of social harms and asks which victims' voices are heard and why. McGarry and Walklate break new ground with this innovative and accessible book; it offers a broad discussion of social harms, the role of the victim in society and the inter-relationship between trauma, testimony and justice and asks: how has harm been understood and under what circumstances have those harms been recognised? how and under what circumstances are those harms articulated? how and under what circumstances are the voices of those who have been harmed listened to? Each chapter draws on case studies and a range of questions designed to assist in reflection and critical engagement. This book is perfect reading for students taking courses on victimology, victims and society, victims’ rights and criminal justice.

Mediation And Criminal Justice written by Martin Wright and has been published by Sage Publications (CA) this book supported file pdf, txt, epub, kindle and other format this book has been release on 1989 with Community-based corrections categories.

The last decade has seen the growth of mediation as an alternative to existing forms of resolution of the criminal justice process. The rise of mediation has been inspired by varied motives: to give victims better outcomes; to relieve the pressures on the courts; to offer courts new ways of resolving disputes; and to restore justice to the community outside the criminal justice system. To what extent can mediation schemes achieve the aims of their exponents? Wright and Galaway assess the international experiences of mediation in theory and in practice. A team of researchers and practitioners draw together experiences in North America, Western Europe and Japan, and examine the extent to which different forms of mediation have succeeded in their aims. They address key problems such as how far it has extended the reach of the criminal justice system. As a major international assessment of the progress of mediation, this book will be essential reading for researchers and lecturers in criminology, social work and law as well as for all concerned with the rights of victims and offenders and with the criminal justice system. "The articles are consistently well written and provide a great breadth of information about the developments in the field." --The Alternative Newsletter "Although mediation of civil disputes has become a growth industry over the past decade, extending the concept into the criminal field has proved more problematic. This first-of-its-kind collection by a group of well-known scholars and practitioners helps explain why this is so . . . . This volume makes a real contribution to the analysis of criminal justice reform. For upper-level students and faculty members." --Choice"A collection with sufficient detail for anyone interested in mediation." --Times Higher Education Supplement "Wright and Galaway have collected a valuable group of essays relating to the use of mediation in the criminal justice system. . . . The essays are generally excellent. . . . They offer a range of valuable insights into some of the fundamental questions facing the dispute resolution community." --The Alternative Newsletter "Mediation and Criminal Justice, edited by two distinguished criminal justice experts, makes an important contribution: A primary intent of the book is to consider the benefits that can be realized by bringing together victims and offenders who don't know each other, and by emphasizing reparative rather than retributive justice. . . . The book provides a diverse set of perspectives from which to form opinions about the merits and drawbacks of mediation." --Judicature
