Although relatively new as a distinct field of study, transitional justice has become rapidly established as a vital field of enquiry. From vaguely exotic origins on the outer edges of political science, the study of 'justice' in times of transition has emerged as a central concern of scholarship and practical policy-making. A process of institutionalisation has confirmed this importance. The ICTY, the ICTR, the ICC, hybrid tribunals in Sierra Leone and East Timor and 'local' processes such as the Iraqi Higher Tribunal (IHT) have energised international law and international criminal justice scholarship. The South African TRC was for a time lauded as the model for dealing with the past and remains one of the most researched institutions in the world. It is one of approximately two dozen such institutions established in different transitional contexts over the past twenty years to assist conflicted societies to come to terms with a violent past. At the national level, international donors contribute huge sums of money to 'Rule of Law' programmes designed to transform national justice systems. This collection seeks to offer something quite different to the mainstream of scholarship in this area, emphasising the need for bespoke solutions to different transitions rather than 'off the shelf' models. The collection is designed to offer a space for diversity, prompted by a series of perspectives "from below" of societies beset by past violent conflict which have sought to effect their transition to justice. In doing so the contributors have also sought to enrich discussion about the role of human rights in transition, the continuing usefulness of perspectives from above, and the still contested meanings of "transition".

Este libro se dedica a uno de los debates internacionales en curso sobre los desafíos conceptuales y prácticas que la diversidad cultural de sociedades pluriculturales ha generado en el ámbito de la justicia transicional. El presente trabajo sobre pueblos indígenas y justicia transicional, fundamentado en una investigación antropológica jurídica en Guatemala, pretende contribuir a reducir la brecha de conocimiento en torno a entendimientos y prácticas indígenas sobre justicia, reparación, búsqueda de verdad y reconciliación para enfrentar las graves violaciones de derechos humanos sufridos durante el conflicto armado (1960-1996). Un hallazgo central de esta investigación es que los procesos de justicia transicional en las comunidades indígenas están permeados por una fuerte dimensión espiritual que problematiza aceptaciones antropocéntricas de los derechos humanos. Este estudio concluye que la visión hegemónica de justicia transicional aún no se ha enfrentado a los retos apremiantes que provocan las visiones indígenas que cuestionan las divisiones de la ontología moderna dominante entre cultura/naturaleza, mente/cuerpo, humanos/no humanos, creencia/realidad. El libro concluye con recomendaciones que los diseñadores de políticas de justicia transicional deberían tomar en consideración cuando elaboran sus intervenciones y mecanismos de justicia transicional para sobrevivientes y comunidades indígenas que enfrentan las secuelas de un pasado lleno de atrocidades.

La garantía efectiva de los derechos humanos, hoy más que nunca, plantea retos difícilmente superables desde las ciencias jurídicas exclusivamente. Es por esta razón que la Cátedra Unesco y la Cátedra Infancia han convocado a otras disciplinas y a los miembros de la Red UNITWIN para llevar a cabo investigaciones sobre gobernanza y los temas objeto de estudio de ambas Cátedras. En la primera sección de esta publicación el lector podrá encontrar cuatro capítulos internacionales que sirven de preámbulo al tema de la memoria histórica: uno dedicado al análisis semiótico de las palabras “verdad” y “justicia”, dos a las políticas de seguridad pública y uno al análisis comparado de la justicia transicional en Colombia y España. Posteriormente, se presentan artículos que abordan la memoria histórica desde distintas perspectivas: la de patrimonio cultural; la de la salud mental; la de la niñez víctima de desplazamiento forzado; la de la relación entre memoria colectiva y dinámicas psicosociales; y la de la apropiación del territorio, generadora de nuevas subjetividades. En la segunda sección se abordan tres problemas que afectan la garantía efectiva de los derechos de algunos niños y niñas en Colombia: para empezar, las prácticas jurídicas que ignoran la alternatividad en el Sistema de Responsabilidad Penal para Adolescentes; posteriormente, el desconocimiento de los derechos sexuales y reproductivos de las personas menores de edad en situación de discapacidad intelectual; y para terminar, algunas definiciones y prácticas que impiden la formación para la autonomía.
