Este estudio tuvo como objetivo analizar a través de una revisión de literatura cómo se lleva a cabo el tratamiento con respecto al embarazo y el parto de las mujeres encarceladas en Brasil y Uruguay; conocer los tipos de violencia obstétrica en relación con las mujeres embarazadas; así como las implicaciones legales, penales y no penales, frente a la realidad de las parturientas y observar si existe legislación específica en Brasil y Uruguay para proporcionar condiciones de punibilidad a aquellos que se configuran como agresores. Lo que se observa es que dentro de las unidades penitenciarias femeninas y mixtas, las vulnerabilidades sociales se potencian debido a las múltiples violaciones de derechos que se producen. Por lo tanto, se puede decir que la criminología feminista ha formulado diversas críticas al sistema penal, comenzando por la actitud que las prisiones reproducen, a través de opresiones y abusos de diversas formas, especialmente hacia las mujeres embarazadas que están encarceladas. Así, a través de un estudio de revisión sistemática de la literatura utilizando un enfoque deductivo de naturaleza cualitativa de carácter exploratorio, se puede concluir que el principio de la dignidad de la persona humana es relevante en la identificación y fundamentación de los derechos sociales, y que la violencia obstétrica, además de ser una forma de violencia institucional, también se considera una violación de los derechos humanos fundamentales de las mujeres, para los cuales existe un amplio marco de protección legal. Se sabe que la violencia obstétrica es una violación constante de la dignidad de la persona humana, ya que las mujeres sufren actos de falta de respeto y abuso, actos inhumanos que pueden causar trastornos psicológicos y físicos en la parturienta o resultar en la muerte de la mujer. Por lo tanto, es deber del Estado respetar la integridad física y moral de las presas que se encuentran encarceladas.
