Having succeeded in establishing themselves in Europe, Asia, Africa and the Americas, in the early 16th century Spain and Portugal became the first imperial powers on a worldwide scale. Between 1580 and 1640, when these two entities were united, they achieved an almost global hegemony, constituting the largest political force in Europe and abroad. Although they lost their political primacy in the seventeenth century, both monarchies survived and were able to enjoy a relative success until the early 19th century. The aim of this collection is to answer the question how and why their cultural and political legacies persist to date. Part I focuses on the construction of the monarchy, examining the ways different territories integrated in the imperial network mainly by inquiring to what extent local political elites maintained their autonomy, and to what a degree they shared power with the royal administration. Part II deals primarily with the circulation of ideas, models and people, observing them as they move in space but also as they coincide in the court, which was a veritable melting pot in which the various administrations that served the Kings and the various territories belonging to the monarchy developed their own identities, fought for recognition, and for what they considered their proper place in the global hierarchy. Part III explains the forms of dependence and symbiosis established with other European powers, such as Genoa and the United Provinces. Attempting to reorient the politics of these states, political and financial co-dependence often led to bad economic choices. The Editors and Contributors discard the portrayal of the Iberian monarchies as the accumulation of many bilateral relations arranged in a radial pattern, arguing that these political entities were polycentric, that is to say, they allowed for the existence of many different centres which interacted and thus participated in the making of empire. The resulting political structure was complex and unstable, albeit with a general adhesion to a discourse of loyalty to King and religion.

En la presente obra se lleva a cabo un estudio novedoso y original del concepto de “obediencia” en la doctrina filosófica y escolástica de la España de los Austria. Contemplada la cronología hispánica en su totalidad, cabría decir que los vasallos del rey de España vivieron sus tres siglos de imperio hablando y teorizando sobre la obediencia mucho más que sobre la rebeldía. Incluso durante los episodios de sublevaciones abiertas, el tema de la obediencia regresaba tercamente al centro del debate con el fin de desplazar a la incómoda y deshonrosa categoría de «rebelde», a la que nadie quería adscribirse. Sorprende, por tanto, la facilidad con que hasta hoy hemos osado interpretar algunos de los levantamientos más notables de la Monarquía, como el de las Comunidades en 1520, Flandes en 1566, Cataluña y Portugal en 1640 o Nápoles en 1647, sin antes haber profundizado lo bastante en las teorías de la obediencia que, si bien implícitas en muchos estudios dedicados a estos conflictos, reclaman un espacio propio. Términos y conceptos como autoridad, disciplina, castigo, disimulación, poder, justicia y tantos más guardan parentesco con la obediencia, incluso a veces la subsumían, pero ni la representaron ni la sustituyeron.

They were given the task of organising and developing public authorities as well as the new society, and in their engagement with the temporary institutions, they were confronted with realities and situations as diverse as they themselves proclaimed them to be. The works brought together in this volume originally appeared in journals and collected works from different countries, and they are now being presented here in a revised edition. Castile was the kingdom overseeing the expansion across the Atlantic; an expansion to lands and peoples unknown to Europeans up till that point in time. The jurists who worked under these new and challenging circumstances belonged to the Castilian tradition, and they were immersed in this tradition not only due to their university education, but also as a result of their cultural environment and the very structure of the governing bodies and justice system of the kingdom. The confrontation with a reality that was, in so many respects, different from that of the Peninsular – as could already clearly be seen in accounts written by conquistadors, missionaries and the authorities from the early days – encouraged jurists to search for solutions to the new problems that had arisen. Over the years, this led to the creation of what would eventually shape a heterogeneously composed normative corpus, both in civil and canon terms. The differences between the Indiano and Castilian systems were marked to the point that it became a widely accepted truth that the Indiano order could not be fully understood or taken into account either by the advisors of Castile or the lawyers who travelled to the Americas with no prior knowledge of this particular law. Jurists who were born or based in the Indiano provinces would often come to discover the “constitutional discourse” of the monarchy; in other words, they experienced the unfolding plot, so to speak, not through theory, but rather through the impetus provided by the possible solutions to the numerous issues that had arisen. Although Castilian legal literature, which exerted a powerful influence, was present and being circulated throughout the Americas, preferences when it came to specific authors and legal bodies were as different as the readings and interpretations made of them. Several criteria both general and specific in nature took shape. Consequently, “local contexts”, for example, were often discussed in the application of general norms and the “customary background” was similarly taken into account."
