This volume provides readers with accounts of the contemporary consequences of the Eurocentric Western model of racialized power and extractivist development: cultural, linguistic, and land dispossession, displacement and forced migration, climate and water injustice, and the environmental destruction of Afro-descendent and indigenous communities in the Americas. The past and present circumstances of Afro-descendent and Indigenous peoples in the Americas have been shaped by the “coloniality of power” of Western capitalist modernity. This Eurocentric Western model of racialized power, with its rhetoric of development, progress, salvation, and improvement and invented categories of nature, race, gender, nation, and knowledge, has resulted in the disposing of the worlds of Afro-descendent and Indigenous peoples. The chapters in this book provide critical theoretical and practical approaches to understanding land, territorial, and cultural dispossession and the forms of resistance practiced and engaged in by rural Afro-descendent communities and Indigenous peoples in the Americas. This book will be of particular interest to all scholars, students, and practitioners of education and development, global studies in education, peace studies, international studies, Latin American and Caribbean studies, as well as those working in sociology, development studies, and socio-environmental justice. En el ámbito del hate speech se crea una tensión insoslayable —y necesaria— entre la libertad de expresión como autonomía individual y la igualdad como no sometimiento, entendida como la no constitución o mantenimiento de grupos subordinados en la sociedad. Los desarrollos teóricos para tratar esta tensión son insuficientes y ambiguos y arrojan como "soluciones" encarar falsos dilemas y sacrificios inaceptables entre la igualdad o la libertad. La inquietud sobre la posible falta de protección de miembros de estos grupos ante discursos de odio o intolerantes y su abordaje en el marco de las garantías a la libertad de expresión motiva la elaboración de este trabajo. Luego de analizar modelos referenciales en la materia, junto a diversos aportes doctrinarios, se plantea desde el liberalismo igualitario una teoría regional de la libertad de expresión con énfasis en el discurso de odio y el discurso intolerante que armonice la relación de nuestros valores más preciados de la democracia liberal y cristalice en una propuesta de ley modelo interamericana contra el discurso de odio. RICARDO F. ROSALES ROA es abogado egresado de la UCAB (Caracas, Venezuela). Magister en Derecho Internacional de los Derechos Humanos por la UBA (Buenos Aires, Argentina), con tesis calificada como "sobresaliente con mención especial". Actualmente es becario completo del Master en Estudios de Desarrollo por el IHEID (Ginebra, Suiza). Se desempeña como Consultor Jurídico de la ONG Espacio Público (Caracas), así como Investigador de la ONG AlertaVenezuela (Bogotá, Colombia). EL LIBRO PROPONE UNA COMPRENSIÓN REFLEXIVA de los principios y valores constitucionales básicos: derechos humanos y régimen democrático. Los derechos contienen la parte sustantiva relativa a la autonomía personal, y la democracia organiza los procedimientos que actualizan el autogobierno, la soberanía popular. La noción de reflexividad no significa pensar atentamente algo; tiene un linaje filosófico y sociológico relacionado con los procesos de modernización que destacan la publicidad y la intersubjetividad de los giros pragmático y lingüístico. Se mueve el foco metodológico del individualismo al enfoque de las prácticas sociales para señalar algunos problemas del constitucionalismo liberal que afectan a sus instituciones y formas argumentativas. En medio de los procesos de diferenciación social, la reflexividad implica la confrontación de la acción humana con otros sistemas normativos. Mediante el acceso a la justicia como derecho llave, permanece vivo el poder constituyente, pero se requiere una esfera pública con múltiples esclusas, sensores y cajas de resonancia, tanto en el plano nacional como internacional o cosmopolita. Las voces de personas que sufren injusticia abonan a un modelo de racionalidad práctica que en las sociedades complejas no se asimila sin más a las razones morales.
