Studienarbeit aus dem Jahr 2007 im Fachbereich Politik - Thema: Europäische Union, Note: 2,0, Helmut-Schmidt-Universität - Universität der Bundeswehr Hamburg, Sprache: Deutsch, Abstract: In diesem Jahr (2007) feiert die Europäische Union den fünfzigsten Jahrestag der Unterzeichnung der Römischen Verträge. Diese bildeten eine der wichtigsten Grundlagen dafür, dass der nach zwei Weltkriegen wirtschaftlich und moralisch am Boden liegende Kontinent Europa, zu einer der wichtigsten Wirtschaftsmächte des beginnenden 21. Jahrhunderts werden konnte. Glaubt man den Darstellungen der Festaktsredner, so gewinnt man den Eindruck, die europäische Integration sei ein kontinuierlicher Siegeszug der europäischen Idee gewesen. Dass dies nicht der Fall ist lässt sich schon an der momentan allgegenwärtigen Krise des europäischen Verfassungsvertrages erkennen. Aus diesem Grund möchte ich mich, nach einem chronologischen Überblick über die europäischen Entwicklung von 1945 bis in die heutige Zeit, den ich in drei Phasen eingeteilt habe, mit den Brüchen in der europäischen Integration auseinandersetzten. Dazu werde ich die „Krise des leeren Stuhls“ (1965/66) analysieren, die einen typischen, auf nationale Egoismen zurückzuführenden, Bruch dargestellt, und ihre Folgen für den Integrationsprozess aufzeigen. Anschließend soll ein kurzer Überblick über zukünftige Herausforderungen gegeben werden, welche meiner Ansicht nach, zukünftig zu solchen Brüchen führen könnten. Ich werde mich dabei auf die Europäische Union und ihre direkten Rechtsvorgänger beschränken. Andere Akteure, die ebenfalls wichtige Beiträge zur europäischen Integration geleistet haben (z.B. Europarat, Organisation for Economic Cooperation and Development (OECD), European Free Trade Association (EFTA)) sollen nur am Rande Erwähnung finden. Während die allgemeine Quellenlage zur Geschichte der europäischen Integration als gut bezeichnet werden kann, fällt auf, dass, vor allem für die Zeit der 60er- bis 80er-Jahre des 20. Jahrhunderts, Literatur nur in ungenügender Quantität vorhanden ist.

The harmonization of the different European legal systems has reached the field of asylum and immigration policy. The Maastricht Treaty has established the legal basis for a common migration policy. This book investigates the history of the post-war welfare state in Germany and its normative foundations, with special emphasis on constitutional issues. The author, formerly Director of the Max-Planck-Institute for Foreign and International Social Law, Munich, and President of the Max-Planck-Society, argues that social policy – not only in Germany – is about struggles over the “social”. The “social” is an open and changing concept that reflects the modern quest for equality, voiced in semantics like justice, participation, inclusion and security. The “social” and the “social state” (the German term for welfare state) are enshrined in the German Constitution of 1949, the Grundgesetz. The book sets out the phases of welfare state development in depth.
