Studienarbeit aus dem Jahr 2007 im Fachbereich Politik - Thema: Europäische Union, Note: 2,0, Helmut-Schmidt-Universität - Universität der Bundeswehr Hamburg, Sprache: Deutsch, Abstract: In diesem Jahr (2007) feiert die Europäische Union den fünfzigsten Jahrestag der Unterzeichnung der Römischen Verträge. Diese bildeten eine der wichtigsten Grundlagen dafür, dass der nach zwei Weltkriegen wirtschaftlich und moralisch am Boden liegende Kontinent Europa, zu einer der wichtigsten Wirtschaftsmächte des beginnenden 21. Jahrhunderts werden konnte. Glaubt man den Darstellungen der Festaktsredner, so gewinnt man den Eindruck, die europäische Integration sei ein kontinuierlicher Siegeszug der europäischen Idee gewesen. Dass dies nicht der Fall ist lässt sich schon an der momentan allgegenwärtigen Krise des europäischen Verfassungsvertrages erkennen. Aus diesem Grund möchte ich mich, nach einem chronologischen Überblick über die europäischen Entwicklung von 1945 bis in die heutige Zeit, den ich in drei Phasen eingeteilt habe, mit den Brüchen in der europäischen Integration auseinandersetzten. Dazu werde ich die „Krise des leeren Stuhls“ (1965/66) analysieren, die einen typischen, auf nationale Egoismen zurückzuführenden, Bruch dargestellt, und ihre Folgen für den Integrationsprozess aufzeigen. Anschließend soll ein kurzer Überblick über zukünftige Herausforderungen gegeben werden, welche meiner Ansicht nach, zukünftig zu solchen Brüchen führen könnten. Ich werde mich dabei auf die Europäische Union und ihre direkten Rechtsvorgänger beschränken. Andere Akteure, die ebenfalls wichtige Beiträge zur europäischen Integration geleistet haben (z.B. Europarat, Organisation for Economic Cooperation and Development (OECD), European Free Trade Association (EFTA)) sollen nur am Rande Erwähnung finden. Während die allgemeine Quellenlage zur Geschichte der europäischen Integration als gut bezeichnet werden kann, fällt auf, dass, vor allem für die Zeit der 60er- bis 80er-Jahre des 20. Jahrhunderts, Literatur nur in ungenügender Quantität vorhanden ist.

An examination of the legal framework of the EU internal market as established in the case law of the European Court of Justice, discussing in particular EC competition law, the free movement of goods, services, persons and capital and the evolution of the interpretation of the provisions. The 'State' has been retreating from direct intervention in economic life as more goods and services, the provision of which was once thought to be a 'public' responsibility, are delivered through market mechanisms. Given the need for consistent application of EC law in the internal market, a common core conception of public authority, shielded from the discipline of EC competition law, is needed. The resulting realignment of public and private functions and responsibilities is not a linear and coherent process, especially in light of the changing nature of the European legal integration project and the progressive incorporation of non-economic values in the Treaties.

Mutual Recognition (MR) implies that each Member State is free to use the standards for production it prefers but cannot inhibit the import from other Member States lawfully using other standards, unless justified by emergency reasons. The home country rule then prevails on the host country. Barriers to entry diminish, competition rises in the internal market. The harmonization of the different European legal systems has reached the field of asylum and immigration policy. The Maastricht Treaty has established the legal basis for a common migration policy. Numerous resolutions, recommendations, joint positions and actions were adopted by the EU Council based on the `third pillar' in the Maastricht Treaty. Within the `first pillar' the European Community has enacted regulations on visa policy based on Art. 100c EC - Treaty. Additionally, several agreements with third countries on immigration issues were set into force. Immigration and Asylum Law and Policy of the European Union comprehensively describes the present state of the harmonization process concerning migration policy in the European Union. Particular emphasis is laid on the legal status of third-country nationals with regard to entry and residence. Furthermore, the gaps within EU regulations are evaluated in an attempt to search for a homogenous European migration policy.

This book investigates the history of the post-war welfare state in Germany and its normative foundations, with special emphasis on constitutional issues. The author, formerly Director of the Max-Planck-Institute for Foreign and International Social Law, Munich, and President of the Max-Planck-Society, argues that social policy – not only in Germany – is about struggles over the “social”. The “social” is an open and changing concept that reflects the modern quest for equality, voiced in semantics like justice, participation, inclusion and security. The “social” and the “social state” (the German term for welfare state) are enshrined in the German Constitution of 1949, the Grundgesetz. The book sets out the phases of welfare state development in depth. Social policies are analyzed in view of wider contexts, especially the nation state, the rule of law (Rechtsstaat), federalism and democracy. The author emphasizes the dialectics between the national character of the welfare state and its manifold international references.
